Local Government (Union Parishads) (Amendment) Act, 1992

Act No.10 of 1992

An Act made to amend the Local Government (Union Parishads) Ordinance, 1983

Whereas it is expedient to amend the Local Government (Union Parishad) Ordinance, 1983 (LX
of 1983) for the purposes mentioned below;

Now, therefore, it is enacted as follows:-

Short title.- This Act may be called the Local Government (Union Parishads) (Amendment) Act,
1992.

2. Amendment of section 6 of Ord. LI of 1983.- In section 6 of the Local Government (Union
Parishads) Ordinance, 1983 (LI of 1983), hereinafter referred to as the said Ordinance,-

     a) in the marginal note, for the words "Term of Union Parishads" shall be substituted
     the words and comma "Term of Union Parishads, etc.";
     b) in sub-section (1),-

          i) for the word "there" shall be substituted the word "five";
          ii) in the provision, for the words "ninety days" shall be substituted the
          words "one hundred eighty days";

     c) after sub-section (1A) shall be inserted the following new sub-section (1B),
     namely:-
     "(1B) Notwithstanding anything contained in this Ordinance, a Union Parishad shall
     be deemed to have been duly constituted after the election of seventy-five percent of
     the total number of its elected members has taken place.
     Explanation.- For calculating the seventy-five percent of the total number of elected
     members, less than point five zero percent shall be ignored and point five zero and
     above percent shall be rounded off into a whole number."

3. Term of the present Union Parishad.- Notwithstanding anything contained in the said
Ordinance or in any other Act, the term of every Union Parishad in office immediately before the
commencement of this Act shall be maintained for three years as if section 6 of the said
Ordinance on Union Parishads had not been amended through the Local Government (Union
Parishads) (Amendment) Ordinance, 1991 (Ordinance No.44, 1991) or this Act.

4. Repeal and savings.- (1) The Local Government (Union Parishads) (Amendment)
Ordinance, 1991 (Ordinance No.44, 1991) stands herewith repealed.
(2) Notwithstanding such repeal, any action done or measure taken under the said Ordinance
amended through the repealed Ordinance shall be deemed to have been done or taken under the
said Ordinance amended through this Act.
