Education Institutes (Law and Order) Ordinance, 1990

Ordinance No.13, 1990

An Ordinance made for the purpose of making special provisions in order to maintain law and order in education institutions

Whereas it is expedient to make special provisions in order to maintain law and order in education institutions;

and whereas the Parliament is not in session and the President is satisfied that circumstances exist which render immediate action necessary;

Now, therefore, in exercise of the powers conferred to him by article 93 (1) of the Constitution of the People's Republic of Bangladesh, the President is pleased to make and promulgate the following Ordinance:-

1. Short title.- This Ordinance shall be called Education Institutions (Law and Order) Ordinance, 1990.

2. Definition.- Unless there is anything repugnent in the subject or context, in this Ordinance "education institution" means university, college, school, madrasa, institute or any other institution which imparts education.

3. Power to give orders for the purpose of maintaining discipline in education institutions.- (1) Notwithstanding anything contained in any other Act for the time being in force, where the Government is satisfied that there have arisen circumstances which are detrimental to public order and discipline and that, as a result thereof, in any education institution, or group of education institutions, of the country or in any education institution, or group of education institutions, of any area-

a) the circumstances for education are deteriorating or threaten to deteriorate,or
b) the normal activities are being seriously obstructed or threaten to be seriously obstructed, or
c) the internal security is being seriously undermined or threatens to be seriously undermined,

i) order the education institution or group of education institutions to be closed,
ii) order its or their halls, hostels or student boarding-houses to be closed,
iii) interdict the holding of meetings, the organizing of processions or demonstrations in the area in which the education institution or group of education institutions is situated.

4. Extension, reduction etc. of the term of an order.- (1) If the Government is satisfied that, the reasons prompting an order under section 3 still being existent, it is, therefore, necessary to extend the term of an order, it may, by order, prolongate that term for a determined period which shall not exceed one month.
(2) Notwithstanding anything contained in this Ordinance, the Government may, if necessary, by order, at any time cancel or amend any order or direction given under section 3.

5. Punishment.- Whoever violates or makes preparations to violate any order or direction given under this Ordinance shall be punishable with imprisonment for a term which may not exceed six months, or a fine not exceeding one thousand Takas, or both.
