Ordinance No.15, 1990

An Ordinance made to repeal the Inland Water Transport (Regulation of Employment) Act, 1965

Whereas it is expedient to repeal the Inland Water Transport (Regulation of Employment) Act, 1965 (E. P. Act III of 1965);
and whereas Parliament is not in session and the President is satisfied that circumstances exist which render immediate action necessary;

Now, therefore, in execise of the powers conferred to him by article 93 (1) of the Constitution of the People's Republic of Bangladesh, the President is pleased to make and promulgate the following Ordinance:-

1. Short title.- This Ordinance shall be called the Inland Water Transport (Regulation of Employment) (Repeal) Ordinance, 1990.

2. Repeal and savings.- (1) The Inland Water Transport (Regulation of Employment) act, 1965 (E. P. Act III of 1965), hereintoafter referred to as the said Act, is herewith repealed.
(2) After the repeal of the said Act,-

a) the Inland Water Transport (Regulation of Employment) Board, henceforth referred to as the said Board, shall be wound up;
b) all properties, whether movables or immovables, funds, cash and money deposited with banks, of the said Board and all its rights and interests concerning those properties shall be transferred to and placed with the Government;
c) all suits and cases filed by or against the said Board shall be deemed suits and cases filed by or against the Government;
d) all debts, obligations and resposabilities of the Board and all arrangements made by or with it shall be deemed debts, obligations and resposabilities of the Government and arrangements made by or with the Government;
e) all the officers and employees of the Board except its secretary shall be transferred to the Government and they shall be public officers and employees and shall, unless changed by the Government, be employed with the Government on the same conditions as before their transfer.
(3) Where any difficulty arises in giving effect to the provisions of subsection (2), the Government may, by order, take all measures necessary to remove such difficulty.
