AIRPORT PASSENGER SERVICE CHARGE ACT

An Act to make provision for the payment of a service charge by airport passengers

Commencement: 1st May 1999

Citation.

1. This Act may be cited as the Airport Passenger Service ChargeAct.

Passenger service charge.

2. (1) Save as otherwise provided in this Act, a passenger service charge shall by payable at the rates specified in the Schedule by each passenger embarking on an aircraft taking off from an airportfor a destination outside Brunei Darussalam.

(2) In subsection (1), “airport” means an airport,aerodrome or landing ground in Brunei Darussalam, owned and operated by the Government.

Exemption from passenger service charge.

3. The following persons are exempted from payment of the passengerservice charge referred to in section 2 —

(a) any member of the operating crew of any aircraft;

(b) any passenger boarding any of the following class ofaircraft —

(i) Brunei Darussalam military aircraft;

(ii) British military aircraft used for military purposes;

(iii) foreign diplomatic aircraft engaged on diplomatic or consularmissions to Brunei Darussalam;

(iv) aircraft engaged in search and rescue missions or exercises;

(v) specified aircraft operated by any Flying Club approved for the purposeof this Act by the Director of Civil Aviation if the flight preceding thelanding or following the take-off, as the case may be, has not been for hire orreward or for any purpose other than club flying;

(vi) such other aircraft or class of aircraft as the Minister mayapprove;

(c) any passenger in transit through Brunei Darussalam who does notleave the transit area or who leaves the transit area due to any interruption toa flight caused by any delay beyond the control of the passenger or the airlineoperation concerned;

(d) infants under the age of 2 years;

(e) such other passengers or class of passengers as the Minister mayapprove.

Amendment of Schedule.

4. The Minister may, with the approval of His Majesty the Sultan and Yang Di-Pertuan, by order amend the Schedule.

Rules.

5. The Minister may, with the approval of His Majesty the Sultan andYang Di-Pertuan, make rules for giving effect to the objects and purposes ofthis Act and for the due administration thereof.

(1) Passengers embarking for destination in BIMP EAGA area $ 5.00
(2) Passengers embarking for other destinations $12.00
