EXCHANGE OF NOTES BETWEEN CANADA AND AUSTRIA REGARDING THE ISSUANCE OF MULTI-ENTRY VISAS TO DIPLOMATIC REPRESENTATIVES, OFFICIALS AND NON-IMMIGRANTS

His Excellency Dr. Kurt Waldheim,
Minister of the Republic of Austria,
Ottawa

Excellency,

I have the honour to refer to previous discussions concerning modification of non-immigrant visa requirements and to suggest that an agreement be concluded between our two Governments in the following terms:

A (1) Diplomatic representatives and officials of Canada accredited in or posted to Austria as well as members of their families and staffs who hold diplomatic or special passports may obtain visas valid for an unlimited number of entries to or departures from Austria during the appointment of the representatives and officials concerned in that country or for the period of validity of their passports whichever is the lesser. Canadian citizens and members of their families holding diplomatic or special passports but who are not accredited to Austria would be admissible to Austria under paragraph B (2) of this Note.

(2) Diplomatic representatives and officials of Austria accredited in or posted to Canada as well as members of their families and staffs who hold diplomatic, special, or service passports may obtain visas valid for an unlimited number of entries to or departures from Canada during the appointment of the representatives and officials concerned in that country or for the period of validity of their passports whichever is the lesser.

B (1) Austrian citizens who are bona fide non-immigrants coming to Canada and who are in possession of valid national passports will receive promptly from the Canadian visa officers in Austria, visas, free of charge, valid for an unlimited number of entries into Canada during a period of twelve months from the date of issue of such visas.

(2) Canadian citizens who are bona fide non-immigrants and who are in possession of valid national passports may without previously obtaining Austrian visas visit Austria up to a period of three months.

(3) It is understood that this modification of entrance requirements does not exempt Austrian and Canadian citizens coming respectively to Canada and Austria from the necessity of complying with the laws and regulations of the country concerned regarding the entry, residence, and employment, or occupation of foreigners, nor is it to be applied in cases of holders of "Fremdenpaesse" (certificates of Identity) i.e. non-Austrian and non-Canadian citizens, and likewise that persons who are unable to comply with the laws and regulations are liable to be refused leave to enter or land.

If the foregoing proposals are acceptable to the Government of the Republic of Austria, I have the honour to suggest that this Note and your reply to that effect shall constitute an agreement between our two Governments which shall come into force on July 1, 1956, and shall be in force until thirty days after the date of the notice of termination by either Government.

OTTAWA, June 19th, 1956

The Honourable Lester B. Pearson,
Secretary of State for External Affairs,
Ottawa

Sir,

I have the honour to acknowledge receipt of your Note of the 28th May, 1956, in which you inform me that the Canadian Government is prepared to conclude with the Government of the Republic of Austria an agreement in the following terms:

(See Note I)

"A (1) Diplomatic representatives. . . Government."

I am authorized to confirm that my Government approves the foregoing provisions and agrees that your Note and this reply shall be regarded as constituting an agreement between the Government of Canada and the Government of the Republic of Austria, which shall take effect on July 1, 1956.
