EXCHANGE OF NOTES BETWEEN THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF PORTUGAL AMENDING PARAGRAPHS 3 AND 4 OF THE ANNEX TO THE AGREEMENT FOR AIR SERVICES BETWEEN THE TWO COUNTRIES SIGNED AT LISBON APRIL 25, 1947

Excellency:

I have the honour to refer to the recent discussions and exchanges of correspondence which have taken place between the Canadian Embassy and the Ministry of Foreign Affairs concerning the proposed modification of the Agreement between Canada and Portugal for Air Services which was signed at Lisbon on April 25, l947.

2. In accordance with the provisions of Article 8 of the Agreement, I now have the honour to propose that paragraphs 3 and 4 of the Annex to the Agreement be modified to read as follows:

(i) in English

"3. The route to be operated by the designated airline of the Government of Canada shall be:

Montreal, via such intermediate stopping places as may be mutually agreed, to the Azores and/or Lisbon and countries beyond in a reasonably direct line in both directions.

4. Canadian Pacific Air Lines, as the designated airline of the Government of Canada, shall, for the operation of this service, be deemed to be qualified to fulfill the conditions referred to in Article 2 paragraph (2) of this Agreement."

(ii) in Portuguese

« 3. A rota a explorar pela empresa aérea designada pelo Governo do Canadá será :

Montreal, via pontos intermediarios que forem mutuamente accordados para os Açores e/ou Lisboa e países além em rotas razoàvelmente directas em ambos sentidos.

4. A Canadian Pacific Air Lines, como empresa aérea designada pelo Governo do Canada deverá, para iniciar a exploração deste serviço ser considerada apta a satisfazer as condições referidas no parágrafo (2) do Artigo II deste Acordo. »

3. If the foregoing provisions are acceptable to the Government of Portugal, I have the honour to propose that this Note and Your Excellency's reply to that effect shall constitute an Agreement between our two Governments and shall come into force on the date of Your Excellency's Note.

The Prime Minister of Portugal to the Ambassador of Canada to Portugal

(Translation)

LISBON, April 30, 1957.

His Excellency Dr. Philippe Panneton
Ambassador of Canada, etc.

Dear Mr. Ambassador,

I have the honour to acknowledge receipt of Your Excellency's note of April 24th last, regarding the change in the Annex to the Agreement between the Government of Portugal and the Government of Canada with respect to air-services between the territories of Portugal and the territories of Canada, signed at Lisbon on April 25, 1947, of which the Portuguese text was as follows:

"I have the honour to refer to the recent negociations and exchanges of correspondence between the Embassy of Canada and the Department of Foreign Affairs regarding a change to be made in the Agreement between Canada and Portugal for Air Services, signed at Lisbon on April 25, l947.

2. "In accordance with the provisions of Article 8 of the Agreement, I now have the honour to propose that paragraphs 3 and 4 of the Annex to the Agreement be altered to read as follows:

(i) in English

"3. The route to be operated by the designated airline of the Government of Canada shall be:

Montreal, via such intermediate stopping places as may be mutually agreed, to the Azores and/or Lisbon and countries beyond in a reasonably direct line in both directions.

4. Canadian Pacific Air Lines, as the designated airline of the Government of Canada, shall, for the operation of this service, be deemed to be qualified to fulfill the conditions referred to in Article 2, paragraph (2) of this Agreement."

(ii) in Portuguese

"3. The route to be exploited by the airline designated by the Government of Canada shall be:

Montreal, via intermediate points which shall be mutually agreed upon, to the Azores and/or Lisbon and countries beyond along reasonably direct routes in both directions.

4. The Canadian Pacific Airlines, as the airline designated by the Government of Canada shall, for the initiation of exploitation of this service, be deemed to be qualified to fulfill the conditions referred to in paragraph (2) Article 2 of this Agreement."

3. In the event that the foregoing provisions should be acceptable to the Portuguese Government, I have the honour to propose that this Note and the reply from Your Excellency further to this matter shall constitute an Agreement between our two Governments, to enter into effect from the date of the Note of Your Excellency."

I have the honour to inform Your Excellency that the Portuguese Government agrees to the proposal contained in the Note above referred to.
