EXCHANGE OF NOTES BETWEEN CANADA AND PORTUGAL CONCERNING NON-IMMIGRANT VISA ARRANGEMENTS BETWEEN THE TWO COUNTRIES

Excellency,

With reference to discussions between officials of this Embassy and your Ministry, I have the honour to propose, on instructions from my Government, a Non-Immigrant Visa Agreement between Canada and Portugal be concluded on the following terms:

1. Portuguese citizens who are bona fide non-immigrants desiring to enter Canada temporarily and who are in possession of valid passports issued by the competent Portuguese Authorities will be granted by the competent Canadian visa issuing officers, with a minimum of delay and formality, gratis non-immigrant visas valid for an unlimited number of entries into Canada during a period of twelve months from the dates of issue of such visas. The period of validity mentioned in the proceeding sentence refers only to the period during which the visas may be used to gain admission at a Canadian port of entry and not to the duration of stay authorized by the Canadian Immigration Authorities at the time of entry.

2. Canadian citizens who are bona fide non-immigrants and who are in possession of valid Canadian passports may visit Continental Portugal and Madeira Islands on business or pleasure or in transit for periods not exceeding two consecutive months without obtaining Portuguese diplomatic or consular visas.

3. It is understood however, that Canadian and Portuguese citizens coming respectively to Continental Portugal and Madeira Islands and Canada shall be subject to the laws and regulations of the country concerned regarding entry, residence (temporary or permanent) and employment or exercise of any professional activity whether remunerative or not applicable to foreigners at the date of entry.

If the foregoing proposals are acceptable to the Government of Portugal, I have the honour to suggest that this Note and Your Excellency's reply to that effect shall constitute an Agreement between our two Governments which shall come into force on February 15, 1958 and shall remain in force until two months after notice of termination by either Government.

The Minister of Foreign Affairs of Portugal to the Canadian Ambassador to Portugal

Sir,

I have the honour to inform Your Excellency that the Government of Portugal is prepared to conclude an Agreement on Visas with the Government of Canada, as proposed in Your Excellency's Note No. 7 of today's date.

The terms of this Agreement would, therefore, be the following:

1. Portuguese citizens, who hold valid passports issued by the competent Portuguese authorities and who wish to enter Canada temporarily but who do not intend to settle in Canada as immigrants, shall be granted visas, free of charge, with a minimum of delay and formalities by the competent Canadian officials, and these visas shall be valid for an unlimited number of entries into Canada during a twelve-month period dating from the day of issuance of the visa. This period of validity refers only to the period of time during which such visas may be used to gain admission at a port of entry into Canada and not to the length of stay allowed, at the time of entry, by the Canadian immigration authorities.

2. Canadian citizens, who hold valid Canadian passports and who do not intend to settle as immigrants may visit Continental Portugal or the Island of Madeira either in transit, on business or recreational trips, for periods of time not exceeding two consecutive months without either a Portuguese Diplomatic or Portuguese Consular visa being required.

3. It is understood that Canadian and Portuguese citizens who, respectively, enter either Continental Portugal or the Island of Madeira, or Canada, shall be subject to the laws and regulations of the country involved governing admission, temporary or permanent residence, employment and the exercise of any professional activity, whether remunerated or not, and applicable to strangers at the date of entry.

In conformity with the proposal presented by Your Excellency, which I have the honour to acknowledge, Your Excellency's note and this reply shall constitute the Agreement between our two Governments with regard to this matter, an Agreement which shall come into force on the 15th of February, 1958, and shall continue operative until two months after notification of its termination by one of the two Governments.

I avail myself of this opportunity to reiterate to Your Excellency the assurances of my highest consideration.
