EXCHANGE OF NOTES BETWEEN THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF THE UNITED STATES OF AMERICA CONSTITUTING AN AGREEMENT COMPLETING THE TRANSFER OF THE REDCLIFF COMMUNICATIONS SITE TO THE GOVERNMENT OF CANADA

The Embassy of the United States of America to the Department of External Affairs of Canada

No. 70

The Embassy of the United States of America presents its compliments to the Department of External Affairs and has the honor to propose that the United States Government release, give up, and transfer to the Government of Canada possession of all rights of access, use, occupancy, title and interest in certain lands located at Redcliff near St. John's, Newfoundland (including the strip of land giving access to Marine Drive), hereafter referred to as the "Redcliff site," together with all improvements thereon including structures.

The Redcliff site was acquired by the United States Government in part under the terms of the Agreement and an Exchange of Notes between the United States of America and Great Britain concerning Leased Bases in Newfoundland (to which Canada succeeded upon the union of Newfoundland with Canada on April 1, 1949) and Protocol between the United States of America, Great Britain and Canada concerning the defense of Newfoundland of March 27, 1941, and in part under the terms of the Agreement of June 15,1966 between the United States of America and Canada on the Continuing Use of Land Adjacent to the Leased Bases Area at Redcliff, Newfoundland. Upon the completion of the above proposed transfer, the Government of the United States of America would be released of all responsibility for the Redcliff site.

If the foregoing is acceptable to the Government of Canada, the Embassy has the honor to propose that this note together with the note of the Department of External Affairs in reply to that effect shall constitute an agreement between the Governments of Canada and the United States of America completing the transfer of the Redcliff site to the Government of Canada and thereby terminating the Agreement of June 15, 1966, between the Governments of Canada and the United States of America on the Continuing Use of Land Adjacent to the Leased Bases Area at Redcliff, Newfoundland, and amending as appropriate all prior Agreements in force between Canada and the United States of America concerning the Redcliff site to comport with this agreement. Administrative arrangements remaining after this exchange of Notes would be attended to by appropriate authorities of the Government of Canada and the Government of the United States of America.

The Embassy of the United States of America renews to the Department of External Affairs the assurances of its highest consideration.

The Department of External Affairs of Canada to the Embassy of the United States of America

The Department of External Affairs presents its compliments to the Embassy of the United States of America and has the honour to refer to the Embassy's Note No. 70 of May 10, 1971, proposing an agreement between the Government of Canada and the Government of the United States of America to provide that the Government of the United States release, give up, and transfer to the Government of Canada possession of all rights of access, use, occupancy, title and interest in certain lands located at Redcliff near St. John's, Newfoundland (including the strip of land giving access to Marine Drive), hereafter referred to as the "Redcliff site", together with all improvements thereon including structures.

The Department has the honour to inform the Embassy that the proposals contained in its note under reference are acceptable to the Government of Canada and to confirm that its note and the Department's reply, which is authentic in English and in French, constitute an Agreement between the Governments of Canada and the United States of America, completing the transfer of the Redcliff site to the Government of Canada and thereby terminating the Agreement of June 15, 1966, between the Governments of Canada and the United States of America on the Continuing Use of Land Adjacent to the Leased Bases Area at Redcliff, Newfoundland, and amending as appropriate all prior Agreements in force between Canada and the United States of America concerning the Redcliff site to comport with this Agreement. It is understood that administrative arrangements remaining after this exchange of notes would be attended to by appropriate authorities of the Government of Canada and the Government of the United States of America.

The Department of External Affairs renews to the Embassy of the United States of America the assurances of its highest consideration.
