EXCHANGE OF NOTES BETWEEN THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF GUATEMALA TO PROVIDE FOR THE EXCHANGE OF THIRD PARTY COMMUNICATIONS BETWEEN AMATEUR RADIO STATIONS OF CANADA AND GUATEMALA

Sir,
I have the honour to propose to Your Excellency on instructions from my Government, that an Agreement be concluded between our two Governments to permit amateur radio stations of Canada and Guatemala to exchange messages or other communications from or to third parties under the following conditions:
(i) no compensation may be directly or indirectly paid on such messages or communications;
(ii) such communications shall be limited to conversations or messages of a technical or personal nature for which, by reason of their unimportance, recourse to the public telecommunications service is not justified. To the extent that in the event of disaster, the public telecommunications service is not readily available for expeditious handling of communications relating directly to safety of life or property, such communications may be handled by amateur stations of the respective countries;
(iii) this arrangement shall be applicable with respect to all amateur radio stations duly licensed by appropriate authorities of Canada or Guatemala;
(iv) this arrangement shall also be subject to termination by either Government giving sixty days advance notice in writing.
If the Government of Guatemala is prepared to accept the foregoing provisions, I have the honour to propose that this Note, which is authentic in English and French, and your reply, shall constitute an Agreement between our two Governments. This Agreement would come into force thirty days after the date of the Exchange of Notes by which the Government of Canada and the Government of Guatemala will have notified each other that all the formalities regarding this Agreement have been fulfilled.
Please accept, Sir, the renewed assurances of my highest consideration.

Sir,
I have the honour to refer to your note number 68 E.41-3, dated November 3 of this year, by which, on behalf of your Government, you propose to the Government of Guatemala that an Agreement be concluded to permit amateur radio stations of Canada and Guatemala to exchange messages or other communications from or to third parties under the following conditions:
(i) no compensation may be directly or indirectly paid on such messages or communications;

In reply, I am pleased to inform you that the Government of Guatemala accepts all the terms of the proposal contained in the note to which I am replying. Therefore, said note and the present one constitute a formal agreement between our two Governments in this regard, which shall come into force thirty days from today, that is to say, on December 8 of the current year.
I take this opportunity to renew the assurances of my highest consideration.
