EXCHANGE OF NOTES BETWEEN THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF COLOMBIA CONSTITUTING A RECIPROCAL AMATEUR RADIO OPERATING AGREEMENT AND AN AGREEMENT TO PROVIDE FOR THE EXCHANGE OF THIRD PARTY COMMUNICATIONS BETWEEN AMATEUR RADIO STATIONS OF CANADA AND COLOMBIA

Excellency,

I have the honour to propose to Your Excellency, on instructions from my Government, that an Agreement be concluded between our two Governments concerning the reciprocal granting of authorization to permit licenced amateur radio operators of either country to operate their stations in the other country during their stay there under the following conditions:

(1) A person who is licenced by his Government as an amateur radio operator and who operates an amateur radio station licenced by such Government shall be permitted by the other Government, on a reciprocal basis and subject to the conditions stated below, to operate such a station in the territory of such other Government.

(2) The person who is licenced by his Government as an amateur radio operator shall, before being permitted to operate his station as provided for in paragraph 1, obtain from the appropriate administrative agency of the other Government an authorization for that purpose.

(3) The appropriate administrative agency of each Government may issue an authorization, as provided for in paragraph 2, under such conditions and terms as it may prescribe, including the right of cancellation at the convenience of the issuing Government at any time.

If the Government of Colombia accepts the foregoing conditions, I have the honour to propose that this Note, which is authentic in French and English, and your reply thereto shall constitute an Agreement between our two countries which shall enter into force fifteen days after the date of Your Excellency's reply. This Agreement shall be subject to termination at any time on sixty days notice, in writing, by either country.

Please accept, Excellency, the assurances of my highest consideration.

I have the honour to propose to Your Excellency on instruction from my Government that an Agreement be concluded between our two Governments to permit amateur radio stations of Canada and Colombia to exchange messages or other communications from or to third parties under the following conditions:

Amateur stations of Canada and Colombia may exchange messages or other communications from or to third parties, provided:

(a) the amateur stations exchanging such third party communications are not paid any direct or indirect compensation therefore; and

(b) such communications shall be limited to conversations or messages of a technical or personal nature, for which, by reason of their unimportance, recourse to the public telecommunications service is not justified.

If the Government of Colombia is prepared to accept the foregoing provisions, I have the honour to suggest that this Note, which is authentic in English and French, and your reply thereto shall constitute an Agreement between our two countries which shall enter into force fifteen days after the date of Your Excellency's reply. This agreement shall be subject to termination at any time, on sixty days' notice in writing by either country.

The Minister of Foreign Affairs of Columbia to the Ambassador of Canada

Sir,

I have the honour to refer to Your Excellency's Notes dated November 5 last, in connection with the Agreements between our two Governments, the first of which aims at permitting amateur radio operators licenced by either country to operate their stations in the other country during their stay there, under the following conditions:

(1) Any person who has been issued an amateur radio licence by his Government and who operates an amateur radio station for which said Government has granted a licence, will be authorized by the other Government, on a reciprocal basis, to operate said station on the territory of said other Government.

(2) A person who has been issued an amateur radio licence by his Government, before being granted permission to operate his station under the terms of paragraph 1, must obtain the pertinent authorization from the appropriate agency of the other Government.

(3) The appropriate agency of each Government may grant the authorization mentioned in paragraph 2, subject to the terms and conditions which it may stipulate, including the right to cancel such authorization at any time, at the discretion of said Government.

The second aims at permitting amateur radio stations of Canada and Columbia to exchange messages or other communications from or to third parties, provided:

a) the amateur radio stations exchanging such third party communications are not paid any direct or indirect compensation therefore, and

b) such communications shall be limited to conversations or messages of a technical or personal nature, for which, by reason of their unimportance, recourse to the public telecommunications service is not justified.

I am pleased to inform Your Excellency that the Government of Colombia accepts the foregoing provisions and that the Spanish texts include in this Note, and which correspond to the French and English texts proposed by Your Excellency, constitute Agreements between our two countries, which shall enter into force fifteen (15) days after the date of this Note. Said Agreements shall be subject to termination at any time, on sixty days' notice in writing by either of the two parties.
