EXCHANGE OF NOTES BETWEEN THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF SWEDEN CONSTITUTING AN AGREEMENT

AMENDING THE EXTRADITION TREATY BETWEEN CANADA AND SWEDEN, SIGNED AT STOCKHOLM ON FEBRUARY 25, 1976

STOCKHOLM

November 18, 1980

Sir,

I have the honour to refer to the Treaty between Canada and Sweden concerning Extradition, signed at Stockholm on February 25, 1976, and to subsequent discussions between representatives of our two Governments concerning an amendment of the Treaty.

Further to those discussions, I have the honour to propose that the Treaty be amended according to the Annexes attached hereto.

If this proposal is acceptable to the Government of Sweden, I have the honour further to propose that this Note and the Annexes, which are authentic in the English, French and Swedish Languages, and your reply to that effect, shall constitute an agreement between our two Governments amending the Extradition Treaty of February 25, 1976 which shall enter into force on the date of your reply.

ANNEX

1. Article 8 of the Treaty is amended by adding thereto a paragraph (5) reading as follows:

"(5) A statement on oath or affirmation, a deposition or any other statement made in accordance with the law of the requesting state shall be admissible as evidence in extradition proceedings in the requested state".

2. A consequential amendment is made to Article 9 by deleting therefrom the words "and any statement on oath or affirmation, taken in the requesting state, or certified copies thereof," and substituting in their place the words "or copies thereof," so that the said Article would commence as follows: "The documents required by Article 8, or copies thereof, shall be admitted ... etc."

I have the honour to inform you that the proposals contained in your Note and the Annexes attached thereto, the texts of which are herewith enclosed, are acceptable to the Government of Sweden and to confirm that your Note and this reply shall constitute an agreement between our two Governments amending the Extradition Treaty of February 25, 1976, which shall enter into force on the date of this reply.

Accept, Sir, the renewed assurances of my high consideration.

I have the honour to refer to the Treaty between Canada and Sweden concerning Extradition, signed at Stockholm on February 25, 1976, and to subsequent discussions between representatives of our two Governments concerning an amendment of the Treaty.
