Protocol between the Government of Canada and the Government of the Arab Republic of Egypt on the establishment of the Canadian Institute in Egypt [1983] CATSer 7 (1 March 1983)

PROTOCOL BETWEEN THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF THE ARAB REPUBLIC OF EGYPT ON THE ESTABLISHMENT OF THE CANADIAN INSTITUTE IN EGYPT

The Government of Canada and the Government of the Arab Republic of Egypt,

Desiring to strengthen cultural relations between their two countries, and pur­suant to the Exchange of Letters done at Cairo on September 21, 1982, constituting an Understanding on cultural cooperation,

Have agreed as follows:

ARTICLE I

On the basis of reciprocity, the Parties agree to the establishment of a Canadian Institute in Egypt, hereinafter referred to as "the Institute". The Canadian side in­formed that the Institute is a private non-profit charitable organization operating within the framework of the Canadian Mediterranean Institute with headquarters in Ottawa, Ontario, Canada.

ARTICLE II

The Institute is a private organization established in accordance with, and sub­ject to, Egyptian laws and regulations.

ARTICLE III

Both Parties agreed that the Canadian Mediterranean Institute in Canada shall be responsible for all financial requirements of the Institute.

ARTICLE IV

The Institute will be headed by a Canadian Director nominated by the Board of Trustees of the Canadian Mediterranean Institute. The Director will be responsi­ble for management of the Institute and the conduct of its programs. The Institute will be staffed by up to 5 Canadians, and Egyptian nationals as required.

ARTICLE V

The purpose of the Institute is to promote study and research in the educational, scientific, cultural, technical, archaeological and historical fields. The Institute will exercise the following activities in accordance with Egyptian laws and regulations:

(a) Assist and promote study and research by Canadian scholars and artists in Egypt, including making all necessary arrangements with the competent Egyptian authorities to facilitate the conduct of research or study in the fields of archaeology, history, language, literature, philosophy, science and the per­forming arts. To this end the Institute will serve as the channel for contacts between Canadian scholars and artists and the Ministry of Higher Educa­tion, the Ministry of Culture and the Academy of Scientific and Technical Research in Egypt.

(b) provide information, assistance and research support to Canadian scholars, researchers and artists visiting Egypt for the purpose of study or research.

(c) provide information, assistance and research support to Egyptian scholars, researchers and artists visiting Canada.

(d) establish a reference library in the various cultural fields mentioned in sub­paragraph (a) of this Article. This reference library will serve scholars, re­searchers and professors of both countries and provide facilities for the study of scientific topics.

ARTICLE VI

(a) The Institute may prepare programs for visits by Canadian scholars appointed as researchers to conduct study or research in educational, scientific, technical and cultural institutions in Egypt, in accordance with Egyptian laws and regulations.

(b) The Institute and scholars will be under the supervision of the Ministry of Higher Education and the Ministry of Culture as appropriate, and shall conform to the requirements set forth by both Ministries.

(c) The Institute will submit, two months in advance, through the Canadian Embassy in Cairo, a list of scholars or researchers appointed to study or to engage in research in Egypt to the appropriate Ministry, together with the topic of research. The competent Egyptian authority may offer comments, if it so wishes, on the topics of the study or research.

(d) The Institute will provide the Ministry of Higher Education and the Ministry of Culture, through the Canadian Embassy in Cairo, with two copies of the approved research work accomplished by Canadian scholars in Egypt.

(e) The Institute will present, through the Canadian Embassy in Cairo, a semi­-annual report on its educational, scientific and cultural activities to the Ministry of Higher Education and the Ministry of Culture.

ARTICLE VII

This Protocol will become effective on the date of an Exchange of Notes by which the Parties notify each other of the completion of any legal procedures necessary for this purpose. It will remain in effect until terminated by either Party on six months written notice to the other.

DONE at Cairo on the 21st day of September 1982, in duplicate, in the English, French and Arabic languages, all texts being equally authentic.
