Agreement between the Government of Canada and the Government of the Union of Soviet Socialist Republics on Co-operation in Space Research and the Use of Outer Space for Peaceful Purposes [1989] CATSer 29 (20 November 1989)

AGREEMENT BETWEEN THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF THE UNION OF SOVIET SOCIALIST REPUBLICS ON CO-OPERATION IN SPACE RESEARCH AND THE USE OF OUTER SPACE FOR PEACEFUL PURPOSES

The Government of Canada and the Government of the Union of Soviet Socialist Republics (hereinafter referred to as the Parties);

PURSUANT to the General Exchanges Agreement between the Government of Canada and the Government of the Union of Soviet Socialist Republics of 20 October 1971 and the Long Term Agreement between the Government of the Union of Soviet Socialist Republics and the Government of Canada to Facilitate Economic, Industrial, Scientific and Technical Cooperation of 14 July 1976;

EXPRESSING their interest in furthering international co-operation in space research and in the use of outer space for peaceful purposes, and desiring to contribute to the further strengthening and development of such co-operation;

DESIRING that outer space remain peaceful and open for co-operation for peaceful purposes;

TAKING account of the terms of the Treaty on Principles Governing the Activities of States in the Exploration and Use of Outer Space, including the Moon and other Celestial Bodies, signed on 27 January 1967, and of other multilateral treaties and agreements on the exploration and use of outer space to which both States are parties;

WITH THE AIM of further developing mutually advantageous co-operation between the two countries in the exploration and use of outer space for peaceful purposes;

Have agreed as follows:

ARTICLE I

The Parties shall encourage co-operation in the fields of space research and the use of outer space for peaceful purposes.

ARTICLE II

Co-operation under this Agreement shall encompass such scientific and applied fields of space exploration as solar-terrestrial physics, remote sensing of the Earth, material sciences and biotechnology, space biology and medicine, space geodesy, space astronomy and may also embrace other fields which may from time to time be decided upon by mutual agreement between the Parties.

ARTICLE III

Co-operation under Article 2 of this Agreement may include some or all of the following activities:

a) arranging exchanges of scientists, specialists, students and trainees;

b) facilitating the development of and participation in joint research and projects, as determined by scientific and other research organizations;

c) exchanging the results of experiments, scientific information and literature;

d) co-operating in joint projects for the design, construction and launch of apparatus;

e) holding joint symposia and conferences; and

f) other joint activities mutually agreed by the Parties.

ARTICLE IV

Each Party shall nominate the appropriate organization(s) which shall be responsible for the implementation of the co-operative activities and experiments developed in accordance with this Agreement.

ARTICLE V

Scientific and technical information obtained through the conduct of joint experiments carried out under this Agreement shall be accessible to both Parties and be transmitted as soon as practicable.

ARTICLE VI

1. The Parties shall, for the purpose of this Agreement, appropriately promote, facilitate and encourage the development of contacts between governmental and non-governmental institutions, scientific research and other organizations of the two countries, including the conclusion of appropriate working arrangements or contracts on implementation of specific projects in accordance with this Agreement. Cooperation under this Agreement may also include projects carried out on a commercial basis.

2. To assure development of fruitful co-operation, each Party shall render every assistance for the travel of scientists and specialists to areas, institutions, and organizations of the other Party appropriate for the conduct of activities under this Agreement.

3. Co-operation under this Agreement shall be realized in accordance with the laws and regulations of each country.

ARTICLE VII

The Parties shall encourage international cooperation in the study of legal questions of mutual interest which may arise in the exploration and use of outer space for peaceful purposes.

ARTICLE VIII

1. This Agreement shall enter into force on the date of its signature and shall remain in force for a period of ten years.

2. Either Party may terminate this Agreement by notifying the other, through diplomatic channels, of its intention to do so. Such termination shall take effect six months after the receipt by one Party from the other Party of the termination note, or at a later date to be agreed by the Parties.

3. The termination of this Agreement shall not affect the validity of arrangements concluded in accordance with paragraph 1 of Article VI of this Agreement which shall continue to completion.

4. This Agreement may be altered at any time by mutual agreement of the Parties.
