AGREEMENT BETWEEN THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF THE REPUBLIC OF FRANCE REGARDING CO-OPERATION AND EXCHANGES IN THE MUSEUMS FIELD

The Government of Canada and the Government of the French Republic, hereinafter called "the Parties",

Considering their Cultural Agreement, signed November 17, 1965, and their Exchange of Letters regarding scientific co-operation of October 23, 1973,

Resolved to encourage the development of their co-operation and exchanges in the museums field,

Have agreed as follows:

ARTICLE I

The Parties shall develop their co-operation and exchanges in the museums field.

ARTICLE II

1. Without prejudice to actions concerning exhibitions carried out pursuant to Article V of the Cultural Agreement of November 17, 1965, the Parties shall develop their co-operation and exchanges in all fields of museum activity, including conservation, restoration, training, research, archaeology, information, inventories and the production of audiovisual documents.

2. The terms and conditions of this co-operation may be set out in administrative arrangements between the relevant administrations of the two Parties.

ARTICLE III

1. The actions referred to in Article II shall apply to the collections within the jurisdiction of the Parties, whether they be artistic, historical, archaeological, ethnographic or scientific in nature.

2. With respect to other collections, the Parties shall encourage co-operation and exchanges between the institutions and individuals concerned.

ARTICLE IV

The Parties shall encourage and facilitate the twinning of specialized institutions working in the museums field.

ARTICLE V

The Parties shall seek opportunities to develop joint actions with third States, in accordance with terms and conditions to be determined by mutual agreement.

ARTICLE VI

In accordance with the Cultural Agreement of November 17, 1965, the Parties shall proceed with the exchange of specialists, materials and information and all other kinds of exchanges in the fields covered by this Agreement.

ARTICLE VII

1. Article 9 of the Cultural Agreement of November 17, 1965, shall govern the conditions of admission and temporary sojourn of nationals of each party concerned by the application of this Agreement, and of their family, on the territory of the other Party.

2. The entry of the personal goods and effects of such nationals shall be governed by the same article.

ARTICLE VIII

The Parties shall permit the temporary entry, exempt from tax and duty, of materials required for the application of this Agreement, in accordance with the laws and regulations in force in each State.

ARTICLE IX

1. A Joint Committee shall be created to present to the competent authorities of each Party recommendations concerning the development of the co-operation and exchanges which are the subject of this Agreement and the means of solving difficulties which arise from its application.

2. The Joint Committee shall meet once every two years alternately in each State. In the interval, it may meet as required.

3. Each Party shall appoint its representatives to sit on the Joint Committee.

4. In accordance with the Cultural Agreement of November 17, 1965, the joint Canadian and French Commission shall study at its meetings the programmes of action presented by the Joint Committee.

ARTICLE X

Each Party shall notify the other of the completion of the formalities required by its Constitution for the entry into force of the present Agreement. The Agreement shall come into force on the first day of the second month following the date of receipt of the second of these notifications.

ARTICLE XI

1. This Agreement shall remain in force for five years following its entry into force and shall be renewable by tacit agreement for periods of five years.

2. At the end of the first period of five years, the Agreement may be terminated at any time by giving six months notice.

3. The termination of the Cultural Agreement of November 17, 1965, shall terminate this Agreement.

4. Projects under way at the time of termination shall continue to benefit from the provisions of the present Agreement until such time as they have been completed.
