FIRST ADDITIONAL PROTOCOL TO THE FREE TRADE AGREEMENT BETWEEN THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF THE REPUBLIC OF CHILE

The plenipotentiaries of THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF THE REPUBLIC OF CHILE (hereinafter referred to as "the Parties"),

ACTING in their capacity as States Party to the Free Trade Agreement signed on December 5, 1996, and duly accredited by their respective Governments in accordance with powers granted in good faith and proper form;

CONSIDERING that the Parties in signing said Agreement had as their primary objective to establish a free trade area, progressively eliminating their tariffs in order to facilitate the flow of goods and services between their territories; and

BEARING IN MIND the powers granted under Article C-02(3) of the said Agreement in order that the Parties may examine the possibility of accelerating the elimination of customs tariffs as set forth in their lists of reductions, and mutually approve an agreement to this effect which will take precedence over any customs tariff or tariff reduction period specified in those lists;

HEREBY AGREE as follows:

ARTICLE 1

To amend the tariff reduction lists of Canada and Chile referred to in Annex C- 02.2 on Tariff Elimination, in the manner indicated in the Annex attached to this Protocol.

ARTICLE 2

The present Protocol and its Annex shall constitute an implementing agreement under the Free Trade Agreement between the Government of Canada and the Government of the Republic of Chile, and shall enter into force on January 1, 2000, once the two governments notify each other through diplomatic channels to the effect that their internal procedures have been fulfilled as set forth under their respective laws.

IN WITNESS WHEREOF the undersigned, duly authorized by their respective Governments, have signed this Protocol.

ANNEX

The provisions of the following schedules are expressed in terms of Annex C02.2 of the Chile-Canada Free Trade Agreement. The harmonized system numbers in the schedule are consistent with the corresponding harmonized system numbers in Annex C02.2 of the Chile-Canada Free Trade Agreement. Goods listed in the schedules shall be free of customs duty effective January 1, 2000.
