EXCHANGE OF LETTERS BETWEEN THE GOVERNMENT OF INDIA AND THE GOVERNMENT OF THE SOCIALIST FEDERAL REPUBLIC OF YUGOSLAVIA CONCERNING CO-OPERATION IN RESEARCH AND DEVELOPMENT OF ATOMIC ENERGY FOR PEACEFUL PURPOSES

Excellency,

I have the honour to say that since 1958, there have been useful contacts between the nuclear scientists of India and the Socialist Federal Republic of Yugoslavia. For example, two Yugoslav scientists availed of training in India against fellowships offered by the Department of Atomic Energy: There has also been exchange of scientific and technical information and publications in the field of development of nuclear energy for peaceful purposes between the Department of Atomic Energy and the Federal Nuclear Power Commission of Yugoslavia.

2. I am now glad to inform you that in fulfilment of the desire expressed informally by both countries for extension of collaboration in this sphere, the Government of India, recognising the great importance of the development of atomic energy for peaceful purposes, and desiring the promotion of measures which will enhance the friendly relations between the two countries, has decided to conclude an Agreement of Cooperation in the research into and development of the uses of atomic energy for peaceful purposes with the Government of the Socialist Federal Republic of Yugoslavia.

3. In pursuance of this aim and in consonance with the conclusions reached during informal approaches, the Government of India and the Government of the Socialist Federal Republic of Yugoslavia agree :

(i) to exchange information concerning the peaceful uses of atomic energy and research connected therewith, except information of a secret nature or information which either party is not free to exchange because it has been obtained from or developed in collaboration with a third party or information which is of commercial value and which the party transmitting it desires to be subject to a special arrangement;

(ii) to arrange for visits of scientists as may be mutually agreed from time to time;

(iii) to extend facilities for the purchase of nuclear materiaIs and equipment required by either party to this Agreement;

(iv) to cooperate with each other in the implementation of such joint projects as may be mutually agreed from time to time;

(v) to grant fellowships and other facilities for training of scientists in each country at the express request of the Government of the other.

4. In conclusion, I propose. that the arrangements embodied in this letter and in your reply thereto should constitute an Agreement between our two countries for collaboration in the uses of atomic energy for peaceful purposes. This Agreement will be in force for a period of five years in the first instance and may be renewed for such periods as the two parties may mutually agree. The Agreement may also by mutual consent be modified or expanded at any time and any part or parts of it embodied in supplementary detailed articles of Agreement. It will come into force on a day to be mutually agreed.

I have the honour to acknowledge your letter No. 13/10/61-ER dated the 8th September, 1965 which reads as follows :

“Excellency

I have the honour to say that since 1958, there have been useful contacts between the nuclear scientists of India and the Socialist Federal Republic of Yugoslavia. For example, two Yugoslav scientists availed of training in India against fellowships offered by the Department of Atomic Energy. There has also been exchange of scientific and technical information and publications in the field of development of nuclear energy for peaceful purposes between the Department of Atomic Energy and the Federal Nuclear Power Commission of Yugoslavia.

2. I hereby confirm that the arrangements embodied in your letter and my reply thereto shall constitute an Agreement between the Governments of the Socialist Federal Republic of Yugoslavia and India for collaboration in the uses of atomic energy for peaceful purposes.
