New Delhi, 15 June 1966The Government of the Federal Republic of Germany and the Government of India,
HAVE agreed as follows :
Article 1
The Contracting parties shall encourage in a spirit of friendship, the development of maritime shipping between their two States and
shall remove possible difficulties in this field.
Article 2
Maritime shipping policies as practised reciprocally by the Contracting Parties in respect of international trade shall be based
on the following principles :
1.Each Contracting Party shall, in regard to trade between the two States, abstain from discriminatory measures that might impair
the maritime shipping of the other Contracting Party or prejudice the principles of free competition or hamper the shipper’s choice
of flag.
2.Each Contracting Party shall in its ports grant to vessels flying the flag of the other State the same treatment that it accords
to vessels flying the national flag. This applies to customs formalities the levying of changes and port dues, freedom of access
to, and the use of the ports; it applies furthermore to all facilities afforded to shipping and commercial operations in respect
of vessels, their crews, passengers and cargoes; this includes in particular the allocation of berths at piers, loading and unloading
facilities and port services.
3. The proceeds accruing to maritime shipping in the other State from services rendered may be used for making payments in the territory
of that State or may be freely transferred into the other State.
Article 3
The Contracting Parties shall see to it that all necessary measures are taken to ensure the implementation of the principles set out
in Article 2 of the present Agreement.
Article 4
The present Agreement shall also apply to land Berlin provided that the Government of the Federal Republic of Germany has not made
a contract declaration to the Government of India within three months from the date of entry into force of the present Agreement.
Article 5
The present Agreement shall enter into force on the date of signature thereof. It may be denounced in writing by either Contracting
Party at any time and it shall be terminated on the expiry of six months from the date of the receipt of such denunciation by the
other Contracting Party.
DONE at New Delhi this l5th day of June, 1966 in six originals, two each in the German, Hindi and English languages, all three texts
being equally authentic. In case of doubt the English text shall prevail.
