The Government of India and the Government of the Federal Republic of Brazil operating through the Indian Atomic Energy Commission
and the Brazilian National Commission for Nuclear Energy respectively hereinafter referred to as AEC and CNEN;
RECOGNISING the need for cooperation between the two countries in matters relating to peaceful uses of nuclear energy which may be
developed by bilateral collaboration in the field of exchange of scientists, scholarships, acquisition or exchange of material, promotion
and exchange of information or results of researches;
FURTHER recognising that such cooperation must be in conformity with internal legislation in India and Brazil and also with the International
Agreements signed by both Governments.
HAVE agreed as follows :
Article I
The Contracting Parties will exchange information on research and experiments in the peaceful uses of Atomic Energy except information
or a classified nature or any information which either Party is not free to exchange because it has been obtained from or developed
in collaboration with a third country.
Article II
The Contracting Parties will, on the basis of reciprocity, offer fellowships and scholarships for the training of the scholars and
promote visits of scientists and technicians in subjects of mutual interest for such period of time as may be mutually agreed upon
by the parties.
Article III
The Contracting Parties will arrange for the lease or sale of material and equipment necessary for the fulfilment of their programmes
of development of nuclear energy for peaceful purpose in accordance with the specific agreements that may be reached in future between
the CNEN and the AEC.
Article IV
The Contracting Parties will cooperate in the development of specific projects of mutual interest in such manner as may be mutually
agreed upon from time to time between the two Commissions.
Article V
The representatives of the CNEN and the AEC will meet whenever necessary to discuss and coordinate the projects including questions
involving cooperation of an industrial nature and any other problems which may arise in the implementation of the present Agreement.
Article VI
This Agreement will be in force for a period of 5 years from the date of exchange of Instruments of Ratification.
(a) This Agreement will be subject to ratification. It will remain in force for a period of 5 years from the date of exchange of
Instrument of Ratification. The Contracting Parties may renew the Agreement for such periods as maybe mutually agreed upon.
(b) This Agreement may be terminated at any time by either Contracting Party and the termination will be effective six months after
the date of notice in writing to the other party.
(c) In the event of the termination of this Agreement, the Contracts concluded and projects undertaken within the framework of this
Agreement will remain in force for the period for which they were originally contemplated unless otherwise agreed upon by the both
parties.
IN WITNESS WHEREOF the duly authorised Representatives have signed the present Agreement in Hindi, Portuguese and English, all the
three texts being equally authentic, and affixed their seals thereto.
DONE in duplicate at the Rio de Janeiro, this eighteenth day of December, one thousand nine hundred and sixty eight (corresponding
to the twenty seventh day of Agrahayana of the Saka year one thousand eight hundred and ninety) in Hindi, Portuguese and English
languages, all the texts being equally authentic, except in the case of doubt when the English text shall prevail.
