Execution of sentence may be suspended on execution of bond by offender
292. When an offender has been sentenced to fine only and to imprisonment in default of payment of the fine and the court issues a warrant under section 291 it may suspend the execution of the sentence of imprisonment and may release the offender on his executing a bond with or without sureties as the court thinks fit conditioned for his appearance before such court on the day appointed for the return to such warrant, such day not being more than fifteen days from the time of executing the bond ; and on that day in the event of the fine not having been paid or realized the court may direct the sentence of imprisonment to be forthwith carried into execution :Provided that where the fine is imposed by the High Court the bond may be conditioned for the appearance of the offender before a Magistrate's Court therein named and such Magistrate's Court shall on the day of appearance, if the fine shall not have been paid or realized, direct the sentence of imprisonment to be forthwith carried into execution. |
