3. Section 38 of the principal Act is hereby repealed and the following new section substituted therefor :-
| 38. For purposes of this Act it shall be lawful for any person authorized by the Controller, or for a police officer not below the rank of a sergeant, or for an authorized member of the Forces not below the rank of a corporal or leading seaman, to take all such steps as may be reasonably necessary for photographing, measuring, finger printing and otherwise identifying-
| | (a) any person who is not a citizen of Ceylon, or | | |
| | (b) any person who is suspected or alleged to have committed an offence under this Act.". | | |
