38.
(1) The Minister shall appoint one of the members of the Commission to be the Chairman. The Chairman shall preside at all meetings of the Commission at which he is present. In the absence of the Chairman from any meeting of the Commission, any member chosen by those present shall preside thereat. |

(2) If the Chairman of the Commission becomes by reason of illness or other infirmity or absence from Sri Lanka temporarily unable to perform the duties of his office, the Minister may appoint a fit and propel person to act in place of such Chairman. |

(3) The Chairman of the Commission may resign his office by letter addressed to the Minister. |
|
(4) The Chairman of the Commission shall, unless he vacates the office of Chairman by resignation or is removed therefrom, hold office as Chairman for the period for which he holds office as a member of the Commission. |

(5) The Minister may without assigning any reason terminate the appointment of any member as Chairman of the Commission and appoint another member as Chairman of such Commission. |
