(1) Where the productivity of the agricultural lands in any area within an administrative district has Improved or is likely to improve as the result of the construction of a development project in such area (whether such construction was before or after the appointed date), and where the expenditure Incurred in such construction was provided in whole or in part by the State or by a State Corporation, the land betterment charges officer for that administrative district may by Order published in the Gazette declare such area to be a " benefited " |

(2) Every such Order shall specify the limits of the benefited area referred to In that Order and the name of the development project in relation to which such benefited area is declared. |
