28.
(1) No person shall explore for, mine, transport, process, trade in or export any minerals except under the authority of, or otherwise than in accordance with, a licence issued in that behalf under the provisions of this Act and the regulations made thereunder: |

(2) A person who purchases minerals after such minerals have been processed, for sale to the public or for incorporation into a semi-finished or finished product shall not be required to hold a licence to trade in such minerals. |

(3) A licence issued to any person under this Act, to mine any mineral may transfer to the licensee the ownership of any mineral mined under the authority of such licence. |

(4) Nothing in the preceding provisions of this section shall be deemed to require any owner or occupant of the surface of any land or the holder of a licence to explore for or mine for minerals on any land, to obtain a licence to mine for and transport any mineral used for the purpose of building, on or from such land. |
