Merchant Shipping Act (No. 52 of 1971) - Sect 113

False declarations

113.
(1) Any person who, in the case of any declaration made in the presence of or produced to a Registrar under this Part, or in any document or other evidence produced to such Registrar,- shall be guilty of an offence and on conviction thereof shall be liable to imprisonment of either description for a term not exceeding one year, or to a fine not exceeding two thousand rupees, or to both such imprisonment and fine.
(a) wilfully makes, or assists in making, or procures to be made any false statement concerning the title to or ownership of or the interest existing in any ship or share in a ship; or
(b) utters, produces or makes use of any declaration or document containing any such false statement, knowing such declaration or document to be false,
(2) Any person who wilfully makes a false declaration concerning the qualification of himself or of any other natural person or of any body corporate to own a Ceylon ship shall (without prejudice to sub-section (3)) be guilty of an offence and on conviction thereof shall be liable to imprisonment of either description for a term not exceeding one year, or to a fine not exceeding two thousand rupees, or to both such imprisonment and fine.
(3) Any ship or share which is the subject of any false declaration referred to in sub-section (2) shall be subject to forfeiture under this Act, to the extent of the interest of the person making the declaration, unless it is proved that the declaration was made without the authority of any person or body corporate on behalf of whom the declaration was made.
