80. Section 174 of the principal enactment is hereby amended by the repeal of subsections (I) and (2) of that section and the substitution therefor of the following subsections ;
| " (1) No person shall be bound by any agreement entered into by him to pay in respect of any journey on an omnibus any fare in excess of the authorized fare referred to in section 173, and any person who has paid any fare in excess of any such authorized fare as may be applicable to the sum paid in excess from the person to whom such sum was paid. |

| (2) Where any person is convicted by any court of a contravention of the provisions of paragraph (a) of section 173 the court may, in addition to any other punishment which it may lawfully impose for that contravention, order the repayment of any sum paid to that person in excess of the highest authorized fare, or the authorized fare, or the fate agreed upon, as the case may be, and such sum shall be recoverable in like manner as a fine imposed by the court, notwithstanding that it may exceed the amount of the line which the court may in the exercise of its ordinary jurisdiction impose.". |
