| (1) Where a person having the ownership of a permanent plantation, apart from the soil, on the land to which a partition action relates Is a party to the action, he shall be entitled only to receive compensation in respect of that plantation. |

| (2) The ownership of a permanent plantation, apart from the soil, on a land may, for the purposes of sub-section (1) of this section, be established by proof of any agreement with the owner of the land or of any custom recognized in the locality in which the land is situated, notwithstanding the provisions of the Prevention of Frauds Ordinance. |
