Partition Law (No. 21 of 1977) - Sect 71

Penalty for dishonest non-disclosure of interested persons

71.
(1) Every party to a partition action who knowing that any person has any interest in the land to which such action relates, fraudulently or dishonestly or omits to disclose In the pleading filed by him the fact that such person has such Interest or that such person Is a necessary party to such action, shall be guilty of an offence and shall, on conviction after summary trial before a Magistrate, be liable to a fine not exceeding one thousand five hundred rupees, or to imprisonment of either description for a period not exceeding eighteen months, or to both such fine and imprisonment.
(2) No prosecution for an offence under subsection (1) of this section shall be entertained without the sanction of the Attorney-General.
(3) A person guilty of an offence under subsection (1) of this section shall also, by reason of his fraudulent or dishonest failure or omission mentioned in that subsection, be guilty of a contempt of the court in which the partition action referred to in that subsection has been instituted and may be punished for such contempt in accordance with the provisions of Chapter LXV of the Civil Procedure Code.
