Sri Lanka Library Association (Amendment) Act (No. 7 of 2004) - Sect 10

Insertion of new sections 12, 13, 14, 15, and 16 of the principal enactment

10. The following new sections are hereby inserted immediately after section 11 of the principal enactment and shall have effect as sections 12, 13, 14, 15, and 16 of that enactment :-
12.
(1) No person shall be admitted as a corporate member of the corporation :-
(a) if he has been adjudged by a competent court, whether in Sri Lanka or outside Sri Lanka to be of unsound mind ;
(b) if having been adjudged as insolvent or bankrupt by a competent court, whether in Sri Lanka or outside Sri Lanka, he has not been granted by such court a certificate to the effect that his in solvency or bankruptcy has arisen wholly or partly from unavoidable losses or misfortunate ; or
(c) if he has been convicted by a competent court whether in Sri Lanka or outside Sri Lanka, of any prescribed offence or of any offence involving moral turpitude and punishable with rigorous imprisonment for a period exceeding three months.
(2) The Council shall disenrol any corporate member who becomes subject to any of the disqualifications specified in paragraph (a), (b) and (c) of subsection (1) of this section : Provided however that the Council may in its discretion re-admit such person when he ceased to be subject to such disqualification.
(3) The Council may disenrol any corporate member who in its opinion has been guilty of professional misconduct. "Professional misconduct" means any act or omission which contravenes the Code of Professional Conduct and Ethics of the Sri Lanka Library Association, for the time being in force :
(4) The Council shall not disenrol, suspend from membership or reprimand any corporate member under the preceding provisions of this section unless a Disciplinary Committee appointed by the Council has, after inquiry, has reported to the Council that such member has become subject to any of the aforesaid disqualifications or has been guilty of professional misconduct.
(5) Where a Disciplinary Committee appointed by the Council is of the opinion that the evidence of any member or the production by any member of any document pertaining to any person or organization would be relevant to or necessary for, such inquiry it shall have the power by a notice in writing to require such person, to attend at such time and place as specified in such notice, in order to give evidence or to produce such document.
(6) The corporate member in respect of whom a Disciplinary Committee has made a finding may appeal against such decision to the Council.
13.
(1) The Council shall cause proper books and accounts to be kept of the income and expenditure, assets and liabilities, and all other transactions of the Corporation.
(2) The accounts of the corporation shall be subject to audit by a person or a body of persons qualified to practice as Chartered Accountants in Sri Lanka, who shall be appointed for such purpose at the Annual General meeting of the corporation.
14.
(1) Every active corporate member of the Association shall be entitled to use the title "Chartered Librarian". A Fellow shall also be entitled to use the initials "FLA (Sri Lanka)" and as Associate the initials "ALA (Sri Lanka)".
(2) Save as aforesaid, no other person or body of persons shall use the title "Chartered librarian" or the initials "FLA ( Sri Lanka)", or "ALA (Sri Lanka)".
(3) Any person who contravenes the provisions of subsection (2) shall be guilty of an offence under this Act.
15.
(1) Any person who is guilty of an offence under this Act shall be liable, on conviction after trial by magistrate, to imprisonment of either description for a term not exceeding six months or to a fine not exceeding rupees five thousand or to both such imprisonment and fine.
16.
(1) The seal of the corporation shall be of such shape, size and design as the Council by resolution determine.
(2) The Council shall be responsible for the safe custody of such seal. The seal shall be affixed to deeds and documents, in the presence of two of its officers, as the council may authorize from time to time, by resolution, and such officers shall attest the affixing thereof in token of their presence."
