Trade Marks Act (No. 30 of 1964) - Sect 65

Mode of giving evidence

65.
(1) In any proceeding under this Act before the Registrar, the evidence shall be given by affidavit in the absence of directions to the contrary, but, in any case in which the Registrar thinks it right so to do, he may take evidence viva voce in lieu of or in addition to evidence by affidavit. Any such affidavit may in the case of appeal be used before the court.
(2) In case any part of the evidence is taken viva voce, the Registrar may exercise the powers conferred on a commission appointed under the provisions of the Commissions of Inquiry Act for compelling the attendance of witnesses and the production of documents and for administering oaths to all persons who shall be examined before such commission.
