Turnover Tax Act (No. 69 of 1981) - Sect 29

Persons liable to pay turnover tax upon liquidation of a company or dissolution of a body of persons

29.
(1) Notwithstanding anything in the Companies Ordinance, where a company is wound up and where any turnover tax to which that company is liable cannot be recovered, then, every person who was a director of the company at any time during the period in respect of which such tax is charged shall be jointly and severally liable for the payment of such tax unless he proves that the default in payment of tax cannot be attributed to any gross neglect, misfeasance or breach of duty on his part in relation to the affairs of the company, and the provisions of this Act as to collection and recovery of turnover tax shall apply accordingly.
(2) Where a body of person is dissolved and where any turnover tax to which such body of persons is liable cannot be recovered, then, every person who was a member of that body of persons during the period in respect of which the tax is charged shall be jointly and severally liable for the payment of such tax unless he proves that the default in payment of tax cannot be attributed to any gross neglect, misfeasance or breach of duty on his part in relation to the affairs of that body, and the provisions of this Act as to collection and recovery of turnover tax shall apply accordingly.
