ANGLICAN CHURCH (PROPERTY) [CAP. 19. 1

CHAPTER 19

ANGLICAN CHURCH (PROPERTY) ORDINANCE

To make some provisions concerning certain property destined for Divine Service according to the rites of the Anglican C hurch, and other property connected therewith.

(21st Ju ne, 1876)*

Enacted by ORDINANCE VI of 1876 as amended by Ordinance XIV of

1895 and Act XXXIX of 1972.

l. This Ordinance may be cited as the Anglican Church

(Property ) Ordinan ce.

2. (1) The right of own ership over the church situate in

Valletta, between Piazza Celsi, Strada Ponente, and Strada Teatro,
bu ilt at the expen se of Her late Majesty Qu een Ad elaide, on a site
gra n t e d by th e Gove rnm e n t of Ma l t a , a n d d e s t i n e d fo r Divi ne Service according to the rites of the Anglican Church, is, by virtue of this Ordinance, transferred to this church as now established.
(2) The own ership of the registers, library, plate an d furniture a ppe rt a i ning to the s a id c hurc h , a r e he re by v e s t e d i n t h e s a id Anglican Church.

Property in Valletta vested in the Anglican Church as now established. Amended by: XIV.1895.1; XXXIX.1972.3.

3. The said Anglican Church is in virtue o f this Ord inance also vested with the right o f ownership over the tenement situate in Rid olfo Street, within the li mits of Slie ma, of whi ch Jane Tro wer, by a dee d dated the seventh of April ei gh teen hundre d an d sixty- s i x, re c e iv e d by No ta ry Ge o rge D o m e n i c o P a ge , ha d m a de a donation to th e Episcopal See of Gibraltar and, for that See, to the Anglican Bish ops who would successively occupy the said See; and th e s a i d A n g l ican C h u rch is m o r e o v er v e s t ed w ith t h e ri g h t o f

owne rs hip ove r the c hurc h whic h , on a po rtion of the s a id tenem ent, ha s si nce , at the expense , w holly or partly, of the s aid J a n e T r owe r , or o f Bi s hop Dr. Wa lt e r J ohn T r o w e r, th e n in possession of the See of Gibraltar, been erected for Divine Service according to th e rites of the said Anglican Church.
4. The said Anglican Church is, in virtue of this Ordinance, likewise vested with the right of ownership over a portion , and the dom ini u m util e ove r the othe r porti on, of the la nd s s i t u a t e in Sli ema, bet ween th e sa id Ri do lfo Street an d Ton n a St ree t, wh ich , by a deed dated th e eightee nt h of Fe brua ry e ighteen hundre d an d seventy-three, received by the said Notary George Domenico Page, th e la te B isho p Ch arl es Amyan d Harris, th en in po sse ssi on of th e sa id See of Gibra l ta r, had purc hase d with his own money and of which he had made a donation to the same See.

Exemption from operation of Mortmain Law. Amended by: XXXIX.1972.4. Cap. 201.

Powers vested in Bishop of Gibraltar exercisable by Anglican Bishop.

5. The said Anglican C hurch is in virtu e of th is Ordinance authorized to hold and enjoy the immovable property mentioned in the foregoing a rticle s, without being bound to sell or tran sfer the same, notwithstanding any provision of the Mortm ain A ct.

6. Any right or power which, by virtue of either of the deeds of donation mentioned in articles 3 and 4, was vested in or gran ted to th e B ishop of Gib raltar for the time being, is h ereb y transferred to the Anglican Bishop for the time being, who by mandate or other a c t o f th e co m p e t e n t au th o r it y, m a y b e au t h o r i z e d to ex er c i s e ep iscopal fun ction s with in b uild ings situ ate in Malta a nd d est ined for Div ine Service accordin g to the rites of th e Anglican Church.

Savin g the provisions of articles 3, 4 and 6, nothing in this Ordin ance cont aine d shal l affec t any d isposit ion exp ressed in any of the de ed s of donation me ntione d in thos e a rti c le s whe re su c h dis pos it ion, i nde pe nde ntly of t h is Ordina nc e , would be va l i d according to law.
