Beverages in Glass Containers and Consumption of Alcohol in Public Places
(San :iljan Local Council) Bye-Laws, 2008
IN exercise of the powers conferred by articles 34, 35(8) and 60 of the Local Councils Act, the San :iljan Local Council has made the following Bye-Laws>-
1.1 The title of these Bye-Laws is the Beverages in Glass Containers and Consumption of Alcohol in Public Places (San :iljan Local Council) Bye-Laws, 2008.
1.2 These Bye-Laws shall come into force on the date of their publication in the Gazette.
2. In these Bye-Laws unless the context otherwise requires>– “the Act” means the Local Councils Act<
“Council” means the San :iljan Local Council<
“designated areas” means those areas designated by the competent authorities for the placement of tables and chairs exclusively for the consumption of food and beverages<
“glass container” includes glass bottles, glasses, and, or any other glass container intended for the serving of any beverages<
“locality” means the locality of San :iljan as delineated in the Act<
“public place” means the streets within the San :iljan locality as shown in Schedule A to these Bye-Laws<
“streets” means those streets shown in Schedule A to these
Bye-Laws, excluding designated areas.
3. No person is permitted to loiter in any public place holding or having on his person any glass container.

4. No person is permitted to carry alcohol in the public place other than in a sealed unopened container.
5. No person is permitted to consume alcohol in public places other than in the designated areas.
6. Any commercial establishment situated within any street or public place as indicated in Schedule A selling beverages, shall>-
(a) affix a notice in Maltese as well as in English as shown in Schedule B to these Bye-Laws, which notice shall be placed in a conspicuous place and be easily legible by the patrons of such commercial establishment< and
(b) provide containers made of a material other than glass if such beverage is to be consumed in any public place.
7. Any person who is in breach of any of the provisions of these Bye-Laws shall, on conviction, be liable to a fine (ammenda) of sixty five euro (€65.00) for such contravention, and to a further fine (ammenda) of ten euro (€10.00) for every day during which any of the provisions of these Bye-Laws is breached.
8. The Beverages in Glass Containers (San :iljan Local Council) Bye-Laws, 2004 are hereby revoked.

1. THE CONSUMPTION OF BEVERAGES
IN GLASS CONTAINERS OUTDOORS IS PROHIBITED BY LAW
