CARRIER-PIGEONS [CAP. 30. 1

CHAPTER 30

CARRIER-PIGEONS ORDINANCE

To make provision respecting carrier-pigeons.

(1st August, 1903)*

Enacted by ORDINANCE XIV of 1901 as amended by Legal Notices: 4 of 1963, 148 of 1975; and Act XLIX of 1981.

1. This Ord inance may be cited as the Carrier-Pigeons

Ordinance.

2. The in tro duction into Malta of carrier-pig eons, whatever th e u se for wh ich th ey are i nte nd ed , sha ll on ly be pe rmi tted from those fore ig n countrie s with which the Government of Malta has entered in to an y co nven tion for the mu tual an d eq ual treatment o f such birds.

3. It shall not be lawful to establish and to main tain carrier- pigeon lofts or to receive carrier-pigeons without a licence from the Minister responsible for the Police.

4. Every person who receives from abroad any carrier-pigeon s h all , w i t h i n t w o d a y s , n o ti fy th e fa ct to th e C o m m i s s i o n er o f Police, giving him the name of the country of origin .

5. Th e tossing of carrier-pigeons of fo reign origin, or of carrie r-pig eon s comi ng from foreig n c oun tries, shal l be permitt ed on ly if th e bi rd s c o m e fr om on e o f t h e c oun tr ie s r e fe rr e d t o i n section 2.

6. The flyin g of carrier-pigeon s may only take place in such localities as sh al l be appo inted b y the M inister respon sib le for the P o lice an d u n d e r th e co n t ro l o f a P o lice o ffi cer d e p u t ed in th at behalf by the M inister respo nsible for the Police.

7. The Minister responsible for the Police may forbid every fl ight of carrie r-pig eons wh ich he has rea son to susp ect, or which appears to be in contravention of the prov isions of section s 2 and 5

8. The Minister responsible for the Police may also , in s p ec ial c i r c um s t a n c e s , ei th e r f o r b id th e im p o r ta ti on an d conveyance of fore ign pigeons, or establish th e conditions unde r which such importation may be permitted.

9. It shall be lawful for any Police o fficer not inferior in rank to a n In spe cto r to order the product io n, for insp ect io n by him, of any pige ons in tended for flyi ng purposes, what ev er may be thei r origin or th e ob ject of their traini ng, wheth er used for sh ooti ng o r belonging to special homing pigeon lofts, and , in any case, to mark the pigeons with a special stamp or to seize the same.

Penalties. 10 . Any person offending against any of the foregoing provisions sh all be liable, on conviction, to a fin e (ammen da) o r to detentio n. The court may also order that the loft be closed.

Aggravating circumstances. Amended by: XLIX.1981.4.

11. Whosoever shall employ any carrier-pigeons in a manner prejudicial to the safety of the State shall be liable o n conviction, to imprisonment for a term from three months to two years.
