EDUCATION ACT (CAP.327)Bye-Laws of 2010 to amend the Bye-Laws of 2005 for the Selection of Applicants for Admission to the Preparatory Course for the Diploma in Health Science Course under the auspices of the Institute of Health Care

IN EXERCISE of the powers conferred upon him by articles 74 (5) and 75 (6) of the Education Act (Cap. 327), the Chancellor of the University of Malta has promulgated the following bye-laws made by the Board of the Institute of Health Care in virtue of the powers conferred upon it by article
81 (1) of the said Act and which have been approved by the Senate of the
University of Malta as required by article 81 (2) of the said Act:

Citation

1. These bye-laws may be cited as the Bye-Laws of 2010 to amend the Bye- Laws of 2005 for the Selection of Applicants for Admission to the Preparatory Course for the Diploma in Health Science Course and shall be read and construed as one with the Bye-Laws of 2005 for the Selection of Applicants for Admission to the Preparatory Course for the Diploma in Health Science Course, under the auspices of the Institute of Health Care, published as Legal Notice 298 of 2005, hereinafter referred to as “the principal bye-laws”.

Applicability

2. These bye-laws shall be applicable for courses commencing in October
2009 or later.

Amendment to bye-law 2 of the principal bye-laws

3. For bye-law 2 of the principal bye-laws there shall be substituted the following:

“Selection of Applicants

2. (1) Whenever the number of students that may be admitted to any or all of the areas of study is limited by Senate in terms of the provisions of bye-law 9 of the Bye-Laws of 2005 in terms of the General Regulations for University Undergraduate Awards, 2004 for the Diploma in Health Science, and the number of eligible applicants exceeds the number of places in the course, the selection of applicants shall be made according to the criteria listed in bye-law 3.

(2) Applicants for the preparatory course leading to a Diploma in Health Science Nursing whose qualifications are obtained by the 31st August preceding the commencement of the course shall be considered after the selection of applicants for the B.Sc.(Hons) degree in Nursing is completed, provided these latter applicants would have obtained their qualifications by the same date.
(3) Applicants for the preparatory course leading to a Diploma in Health Science Nursing whose qualifications are obtained following resits taken in the September preceding the commencement of the course shall be considered after selection of all applicants for the B.Sc.(Hons) degree in Nursing, and after selection of applicants in accordance with paragraph (2) of this bye-law is completed.”

Amendment to bye-law 3 of the principal bye-laws

4. For paragraph (3) of bye-law 3 of the principal bye-laws there shall be substituted the following:
“(3) For the purpose of selection, applicants whose qualifications were obtained by 31st August preceding the commencement of the course shall be considered first.”
