ENVIRONMENT AND DEVELOPMENT PLANNING ACT (CAP. 504)Conservation of Wild Birds (Framework for Allowing a Derogation Opening a Spring Hunting Season for Turtle Dove and Quail) (Amendment) Regulations, 2011

BY VIRTUE of the powers conferred by articles 61 and 62 of the Environment and Development Planning Act, the Prime Minister has made the following regulations:

1. The title of these regulations is the Conservation of Wild Birds (Framework for Applying a Derogation Opening a Spring Hunting Season for Turtledove and Quail) (Amendment) Regulations,

2011 and these regulations shall be read and construed as one with the
Conservation of Wild Birds (Framework for Applying a Derogation Opening a Spring Hunting Season for Turtledove and Quail) Regulations, hereinafter referred to as "the principal regulations".

2. In regulation 3 of the principal regulations for the words "by means of a notice in the Gazette." there shall be substituted the words "by means of a notice in the Gazette:" and immediately thereafter there shall be added the following new proviso:

"Provided that the Minister shall not open the spring hunting season when the hunting for the two species concerned during the previous autumn hunting season may be considered as having constituted a satisfactory solution in terms of Article
9(1) of Directive 2009/147/EC of the European Parliament and of the Council of 30 November 2009 on the conservation of wild birds, and taking into consideration the thresholds established in Annex I.".

3. Regulation 4 of the principal regulations shall be amended as follows:

(a) subregulation (2) thereof shall be substituted by the following:
"(2) The Spring Hunting Licences which may be issued under these regulations shall be against payment of a fee not exceeding fifty euro (€50) for each licence.";
(b) subregulation (3) thereof shall be deleted; and

(c) subregulation (4) thereof shall be renumbered as subregulation (3).

4. Regulation 5 of the principal regulations shall be amended as follows:

(a) in paragraph (a) thereof for the words "contained in Annex 1 to these regulations;", there shall be substituted the words "contained in Annex I to these regulations and taking into consideration the conservation status of the two species concerned and the maintenance of the population of the species at a satisfactory level;"; and
(b) for paragraph (h) thereof there shall be substituted the following new paragraph:
"(h) provide that hunting can only take place on Monday to Friday from two hours before sunrise to three o’clock in the afternoon and on Saturdays from two hours before sunrise to noon;".
