ENVIRONMENT AND DEVELOPMENT PLANNING ACT (CAP. 504)Conservation of Wild Birds (Amendment) Regulations, 2011

BY VIRTUE of the powers conferred by articles 61 and 62 of the Environment and Development Planning Act, the Prime Minister has made the following regulations:

1. The title of these regulations is the Conservation of Wild Birds (Amendment) Regulations, 2011, and these regulations shall be read and construed as one with the Conservation of Wild Birds Regulations, hereinafter referred to as "the principal regulations".2. Subregulation (6) of regulation 10 of the principal regulations shall be amended as follows:

(a) in paragraph (a) thereof for the words "during which hunting may be allowed;" there shall be substituted the words "during which hunting may be allowed:" and immediately thereafter there shall be added the following new proviso:
"Provided that in exceptional circumstances determined in conjunction with the Minister, the recommendation shall be submitted to the Minister at least two weeks prior to the proposed start of the open season during which hunting may be allowed;"; and
(b) in paragraph (b) thereof for the words "during which taking may be allowed;" there shall be substituted the words "during which taking may be allowed:" and immediately thereafter there shall be added the following new proviso:
"Provided that in exceptional circumstances determined in conjunction with the Minister, the recommendation shall be submitted to the Minister at least two weeks prior to the proposed start of the open season during which hunting may be allowed;".

3. Subregulation (5) of regulation 12 of the principal regulations shall be amended as follows:

(a) in paragraph (a) thereof for the words "between the
1st and the 31st January of every year", there shall be

substituted the words "within one week from the end of the period for which it has been issued in accordance with Schedule IV to these regulations"; and

Amends regulation 13 of the principal regulations.

(b) in paragraph (b) thereof for the words "All new licences or renewals" there shall be substituted the words "Annual licences or renewals".

4. In subregulation (2) of regulation 13 of the principal regulations for the words "A permit cannot be renewed" there shall be substituted the words "A permit cannot be issued or renewed".5. For paragraph 2 of Schedule IV of the principal regulations there shall be substituted the following new paragraph:

" 2. The Carnet de Chasse will be issued for each year which, for the purposes of the carnet de chasse, starts after the closure of the previous autumn open season and ends with the closure of the autumn open season of that year, even if the autumn open season closes in the first weeks of the following year.".
