EMERGENCY COMPENSATION BOARD (TRANSITIONAL PROVISIONS) ACT

To provide for the disposal of matters pending before the Emergency

Compensation Board.

Enacted by ACT XIII of 1949.

(28th June, 1949)*

1. This Act may be cited as the Emergency Compensation

Board (Transitional Provisions) Act.

2. Notwithstanding the repeal or expiry of regulation 59 of the Malta Defence Regulations, 1939, and of the Compensation (Emergency) Regulations, 1943, both continued in force by the

Ex piri ng Law s Co nti nuance Act, 194 8 † , t h e Emer gency Compensation Board shall continue in operation, being constituted, exercising the same functions and proceeding in the same manner
as heretofore, for the purpose of disposing of all cases now pending before it or which may hereafter be brought before it in respect of matt er s fallin g t o b e regul at ed by the said Co mpensatio n
(Emergency) Regulations, 1943; and these regulations shall for that purpose only be deemed to continue in force accordingly.

3. The repeal or expiry of the said regulation 59 of the Malta Defence Regulations, 1939, and of the Compensation (Emergency) Regulations, 1943, shall not in any way affect the validity or effect of any decision which, before the commencement of this Act, has been, or, at any time thereafter, in pursuance of this Act may be given by the Emergency Compensation Board, or affect any right, obligation or liability, acquired, accrued, or incurred under any such decision.

Short title.

Emergency Compensation Board to continue in operation for the disposal of pending proceedings.
