Exclusive Zones for Barbecues

(Birżebbuga Local Council) Bye-Laws, 2011

IN exercise of the powers conferred by article 34, 35(8) and
60 of the Local Councils Act, the Birżebbuġa Local Council has made the following Bye-Laws:-

1.1 The title of these Bye-Laws is the Exclusive Zones for

Barbecues (Birżebbuġa Local Council) Bye-Laws, 2011.

1.2 These Bye-Laws shall come into force on publication.

2. I n t h e s e B y e - L a w s , u n l e s s t h e c o n t e x t o t h e r w i s e requires:-

“the Act” means the Local Councils Act;
“barbecue” includes cooking or roasting of foodstuffs, which is carried out in any manner, including by means of naked fire or through gas or by any other means;
“the Council” means Birżebbuġa Local Council; “exclusive zone for barbecues” means the area with a
defined boundary as shown in the Schedule to these Bye-
Laws;
“locality” means the Birżebbuġa locality;
“ r e s i d e n t s ” i n c l u d e b o t h t h o s e p e r s o n s w h o a r e permanently resident in the locality as well as those who are temporary residents.

3. Barbecues may only be organised in the exclusive zone for barbecues designated by the council as shown in these Schedule to these Bye-Laws.

4.1 Places in these zones shall be taken on the basis of the first come first served principle.

Citation and commencement.

Interpretation.

Barbecues can only be made in the zones indicated by the Council.

Terms and Conditions.

4.2 No authorisation is required from the Council to organise barbecues within the exclusive zone established by these Bye-Laws.

4.3 No music is allowed to be played whatever the means used, which can be heard at a distance of not more than ten metres.

Penalties.

5.1 Any person who is in breach of any of the provisions of these Bye-Laws, or who fails to abide by any condition made by the virtue of these Bye-Laws, shall be deemed to have committed a contravention and shall, on conviction, be liable to a fine (ammenda) of not more than seventy euro (€70) for such contravention.

5.2 In addition to the penalty stipulated in bye-law 5.1 , the Council may order the guilty person of a breach to carry out the necessary repairs to the Council’s satisfaction.

5.3 The Council shall have the right to carry out the necessary repairs at the expense of the guilty person.
