FEES ORDINANCE (CAP. 35)
Fees (Radiocommunications) (Amendment) Regulations, 2008
IN exercise of the powers conferred by article 2 of the Fees Ordinance, the Minister for Competitiveness and Communications with the concurrence of the Prime Minister and Minister for Finance, has made the following regulations-

Amends Section II of the Schedule to the principal regulations.

1. (1) These regulations may be cited as the Fees (Radiocommunications) (Amendment) Regulations, 2008 and shall be read and construed as one with the Fees (Radiocommunications) Regulations, 1995, hereinafter referred to as “the principal regulations”.
(2) These regulations shall be deemed to have come into force on the 1st January 2008.
2. Section II of the Schedule to the principal regulations shall be amended as follows>
(1) item 5 thereof shall be amended as follows>
i) the words “, per annum fee” shall be deleted
ii) sub-item (a) therefore shall be substituted with the following>
“(a) Radiocommunications apparatus installed on board a ship including renewal of licence>
(i) GMDSS installation complying with the
SOLAS Convention ....................................... € 115.00
(ii) MF # HF installation and, or earth station installed on board a ship>
a. of less than 24 meters in length overall … € 35.00 b. equal to or more than 24 meters in length
overall …………………………………………€ 115.00
(iii) VHF station, operating in the frequency band 156.0125 - 162.0375 MHz, 25 kHz
channel spacing …………………...………… No charge
(iv) VHF hand-portable, operating in the frequency band 156.0125 - 162.0375 MHz,

(v) Emergency Position-Indicating Radio Beacon (EPIRB) station, operating in the frequency band 406.0 - 406.1 MHz or

and
iii) item (b) thereof shall be deleted and items (c) to (f) shall be renumbered as items (b) to (e)<
(2) item 6 thereof shall be substituted with the following> “6. Provisional licence for Radiocommunica-
tions apparatus installed on board a ship fee
payable on the issue of a provisional licence for a period not to exceed six months>
(i) GMDSS installation complying with
the SOLASConvention .............................. €115.00
(ii) MF # HF installation and or earth station installed on board a ship>
a. of less than 24 meters in length overall € 35.00 b. equal to or more than 24 meters in

Provided that the provisions of this Section as amended with effect from the 1st January, 2008>
(i) shall not give rise to any right to claim an abatement or refund, and
(ii) shall not prejudice the validity of any payment made or the right to claim any payment which was due prior to the 1st January, 2008<
in respect of any licence issued, granted, renewed or due to have been renewed prior to the 1st January, 2008 in accordance with this Section as then in force, notwithstanding that any such licence covered or would have covered any period after the 1st January, 2008.
3. The words “10.00,0” in Section III of the Schedule to the principal regulations shall be substituted with the words “€35.00”.

Amends Section VI of the Schedule to the principal regulations.

4. (1) Item 3 of Section VI of the Schedule to the principal regulations shall be substituted with the following>
“3. Exemptions €230.00”<
and
(2) after item 3 of Section VI of the Schedule to the principal regulations, there shall be added the following new items>
“4. Administrative services related to maritime licences not otherwise covered by
the above mentioned fees …………………… € 35.00
5. Assignment of Maltese identities for
apparatus by a general authorisation………… € 55.00”.
