CHAPTER 95

LIGHTING CONTROL ORDINANCE

To provide for the total or partial cessation of lighting in Malta by regulation on occasions of emergency or public danger or by way of experiment or practice for such occasions.

ORDINANCE VIII of 1938, as amended by Ordinance XXV of 1962; Legal Notice 4 of I963; Act XIII of 1983; and Legal Notice 408 of 2007.

1. The short title of this Ordinance iss the Lighting Control

Ordinance.

2. On any occasion which the Prime Minister may consider to be an occasion of emergency or public danger, and also whenever he may consider it necessary by way of experiment or practice for any such occasion, the Prime Minister may make such regulations as he may consider desirable providing, either by express command or by request for co-operation, for the total or partial cessation of lighting in Malta.

3. Compliance with any such express command or with any such request for co-operation shall exonerate any person from any liability contractual or otherwise for damage resulting from such comp liance, provi ded that su ch person h a s taken all o t her reasonable measures possible to avoid such damage.

4. Any person who refuses or fails to comply with any such express comm and shall be liable, o n con v ict i on, to a fine (ammenda) not exceeding one hundred and sixteen euro and forty- seven cents (116.47).

Short title.

Power to make regulations. Amended by: XXV.1962.4; L.N. 4 of 1963.

Exoneration from liability of persons complying with regulations.
