CHAPTER 316

MALTA-LIBYA CONTINENTAL SHELF DELIMITATION (RATIFICATION) ACT

To ratify an Agreement delimiting an area of the Continental Shelf between the Republic of Malta and the Great Socialist People's Libyan Arab Jamahiriya.

Enacted by ACT III of 1987.

(29th January, 1987)*

l. This Act may be cited as the Malta-Libya Continental

Shelf Delimitation (Ratification) Act.

2. The Agreement between the Republic of Malta and the Gr eat Socialist People’s Libyan Arab Jamahiriya im plementing Article III of the Special Agreement and the Judgement of the International Court of Justice, signed on 10th November, 1986 and a copy of which is contained in the Schedule to this Act, is hereby ratifi e d and auth ority is hereby g i ve n fo r th e ex ch an ge of t h e instruments of ratification relative to the said Agreement for the purposes of Article 4 thereof.

IMPLEMENTING

ARTICLE III OF THE SPECIAL AGREEMENT

AND

THE JUDGEMENT OF THE INTERNATIONAL COURT OF JUSTICE

The Great Socialist People’s Libyan Arab Jamahiriya and the Republic of Malta.
Desiring to implement Article III of the Special Agreement signed between the two countries on 24 Jumada Al-Ula, 1396, corresponding to 23rd May, 1976, and the Judgement of the International Court of Justice rendered on 3rd June, 1985, in the case concerning the Continental Shelf, Libyan Arab Jamahiriya/Malta.
Have agreed as follows:

Article 1

The delimitation of the area of continental shelf appertaining to the Great Socialist People’s Libyan Arab Jamahiriya and to the Republic of Malta respectively within the meridians 13° 50' east and 15° 10' east shall be arcs of great circles between the following points in the sequence given below:

The position of the points in this Article are defined by latitude and longitude on
European Datum.

Article 2

For illustrative purposes only the boundary line defined by the coordinates indicated in Article 1 above is depicted on the Admiralty Chart No. 176 Scale
1:1,100,000 at latitude 39°00 published by Taunton, 31st October 1969, which is annexed to and forms an integral part of this Agreement.

Article 3

If it is established that natural resources on the seabed or in its subsoil extend on both sides of the continental shelf boundary, as defined in this Agreement, in such a way that resources situated in the area of continental shelf of one Party are exploitable, wholly or in part, from the area of continental shelf of the other Party, the competent authorities of the two countries shall undertake to consult with each other with a view to determining the manner in which these resources are to be exploited.

Article 4

This Agreement shall enter into force on the date of the exchange of instruments of ratification*
DONE at Valletta, on 7 Rabia el Ewwel 1396 corresponding to 10 November 1986 in duplicate, in the Arabic and English languages, both texts being equally authentic.
