MOTOR VEHICLES INSURANCE (THIRD-PARTY RISKS) ORDINANCE (CAP. 104)
Compensation Body Regulations, 2004
IN exercise of the powers conferred by article 23 of the Motor Vehicles Insurance (Third-Party Risks) Ordinance, the Minister for Transport and Communications, has made the following regulations>–
1. (1) The title of these regulations is the Compensation
Body Regulations, 2004.
(2) These regulations shall come into force on the 1st
March, 2004.
2. In these regulations, unless the context otherwise requires –
“the Ordinance” means the Motor Vehicles Insurance
(Third-Party Risks) Ordinance<
“the Fund” means the Protection and Compensation Fund established by Article 49 of the Insurance Business Act.
3. The Compensation Body referred to in article 9C of the Ordinance, shall be the Bureau defined for the purposes of sub- regulation (1) of regulation 23 of the Protection and Compensation Fund Regulations, 2003, known as the Motor Insurers Bureau.
4. Every insurer carrying business of motor insurance in Malta shall pay a contribution to the Compensation Body to be utilised exclusively for the payment of claims of civil liability by the Compensation Body. The Compensation Body shall establish such contribution, taking into account the sums required, or expected to be required, for the purpose of the Compensation Body.
5. No payment shall be made by the Compensation Body in those circumstances where no payment would have been made by the Fund pursuant to paragraph (b) of regulation 28 of the Protection and Compensation Fund Regulations, 2003.

Limits of liability.

6. In considering compensation to any application for payment, the Compensation Body shall take into account any other amount of compensation made to the applicant in respect of the same liability under any other law.
7. In all cases of compensation, the total liability which shall be required to be made by the Compensation Body shall be up to the same amount as is required to be covered by a policy of insurance under the Ordinance or by such regulations as may be issued from time to time.
