PUBLIC GARDENS (CLOSING) [CAP. 34. 1

CHAPTER 34

PUBLIC GARDENS (Closing) ORDINANCE

To provide for the closing to the public of public Government gardens or pleasure grounds on certain days.

(26th May, 1905)*

Enacted by ORDINANCE VII of 1905 as amended by Ordinance IX of

1946; Government Notice 67 of 1952; Act VI of 1955; Legal Notices: 4 of

1963, 8 of 1968; and Acts: XXV of 1968 and XXII of 1976.

1. This Ordinance may be cited as the Public Gardens

(Closing) Ordinance.

2. The Minister responsible for agriculture may on such days as he shall think fit close to the public any public government garden or pleasure ground or any part thereof, and may grant the use of the same, either gratuitously or for payment, to any public association, institution, or charity, or for any agricultural, horticultural, or other show, or for any other public purpose, or may use the same for any such show or purpose; and the admission to the said garden or pleasure ground, or such part thereof, on the days when the same shall be so closed to the public, may be either with or without payment, as directed by the Minister responsible for agriculture, or, with his consent, by the society or persons to whom the use of the garden or pleasure ground, or such part thereof, may be granted.

3. (1) Except in the case of the public government gardens or pleasure grounds mentioned in the Schedule hereto, the days on which public government gardens or pleasure grounds may be closed shall not exceed twelve days in any one year, nor four consecutive days on any one occasion:

Provided that, in any year in which the Malta Trade Fair is held, the number of days above-mentioned, in respect of the garden or pleasure ground in which the fair is held, shall be twenty and ten respectively.
(2) The Minister responsible for agriculture may, from time to time, add other public government gardens or pleasure grounds to the Schedule hereto or otherwise vary the Schedule hereto, in each case by notice published in the Government Gazette.
