Body Piercing (Control) Regulations, 2008
IN exercise of the powers conferred by article 26 (a) (i) of the Public Health Act, the Minister of Health, the Elderly and Community Care has made the following regulations>
1. (1) The title of these regulations is the Body Piercing
(Control) Regulations, 2008.

Title and commencement.

(2) These regulations shall come into force on the 1st June,
2. In these regulations, unless the context otherwise requires -
“body piercing” means the piercing of any part of the body for cosmetic purposes, but does not include the piercing of the body carried out by a healthcare professional as part of the treatment and care of patients and the piercing of the ear with a pre-sterilised, single-use stud and clasp piercing system<
“the Superintendent” means the Superintendent of Public
Health.
3. (1) No person shall>
(a) conduct any form of body piercing unless such person has been authorised in writing by the Superintendent for such purpose< and
(b) use any establishment or premises or part or whole of a building for the purpose of conducting therein or thereat any form of body piercing unless such establishment or premises, or part or whole of a building, is covered by a valid licence issued for such purpose by the Superintendent.
(2) The Superintendent may subject the granting and renewal of the permit to such conditions he deems fit to impose in the interest of pubic health.

Offences.

4. (1) No person shall have in his possession, or keep in any establishment or premises, any instrument, equipment, material or other object associated with the trade of body piercing unless such person holds a valid permit issued by the Superintendent in terms of regulation
3 hereof.
(2) Such permit shall be valid for a period of one year and may be renewed for further periods of one year each by the Superintendent.
5. Any person who commits an offence against these regulations shall be liable -
(a) on a first conviction, to a fine (multa) of not less than two hundred, thirty two euros and ninety-four cents (€232.94) and not exceeding four hundred, sixty five euros and eighty-eight cents (€465.88)< and
(b) on a second or subsequent conviction, to a fine (multa) of not less than four hundred, sixty five euros and eighty-eight cents (€465.88) and not exceeding two thousand, three hundred and twenty-nine euros and thirty-seven cents (€2329.37).
