PRODUCT SAFETY ACT (CAP. 427)
Motor Vehicles (EC Type Approval) (Amendment) Regulations, 2007
IN exercise of the powers conferred by articles 38 to 40 of the Product Safety Act, 2001, the Minister for Competitiveness and Communications, on the advice of the Malta Standards Authority, has made the following regulations>-
1. (1) The title of these regulations is the Motor Vehicles (EC Type Approval) (Amendment) Regulations, 2007, and they shall be read and construed as one with the Motor Vehicles (EC Type Approval) (Amendment) (No. 2) Regulations, 2006, hereinafter referred to as “the principal regulations”.
(2) The present regulations implement the requirements of Directives which amend Directives 2005#55#EC and 2005#78#EC. This includes the requirements of Commission Directive 2006#51#EC of 6
June 2006 amending for the purposes of adapting to technical progress Annex I to Directive 2005#55#EC of the European Parliament and of the Council and Annexes IV and V to Directive 2005#78#EC as regards requirements for the emission control monitoring system for use in vehicles and exemptions for gas engines< and any subsequent amendments of these Directives.
(3) The regulations shall apply from the 8th November 2006.
2. For regulation 2 of the principle regulations there shall be substituted the following>
“2. References to directives 88#77#EEC,
91#542#EEC, 1999#96#EC, and 2001#27#EC in the principal regulations shall be construed as references to directive
2005#55#EC as amended by 2005#78#EC and shall be read in accordance with the correlation table in Schedule I, hereto.
(a) The latest amendment of Directives
2005#55#EC and 2005#78#EC shall be taken into account.”
