CHAPTER 306

SUPPLIES AND SERVICES (CRIMINAL PROCEEDINGS) (JURISDICTION) ACT

To establish the jurisdiction for the trial of persons charged with offence against the Supplies and Services Act, (Cap. 117) and regulations made thereunder.

Enacted by ACT XII of 1983, as amended by Act VIII of 1990.

1. This Act may be cited as the Supplies and Services

(Criminal Proceedings) (Jurisdiction) Act.
2. All offences against the Supplies and Services Act, and against any regulations made thereunder committed after the 9th day of December, 1982, shall be tried by the Court of Magistrates, and, save as in s o far as they are n o t i n consistent wit h th e provisions of this Act, the provisions of the Criminal Code shall appl y to proceeding s befo re su ch court and to p r oceedings o n appeal from any judgment of the said court:
Provided that proceedings may be commenced at any time within one year from the commission of the offence:
Provided further that the Attorney General shall always have a right of appeal to the Court of Crim in al Ap peal from any judgment given by the Court of Magistrates.

3. (1) All cases which, on the 28th day of June, 1983, were pendin g before t h e Tr i bunal referred to i n th e Price Cont rol Tribunal (Constitution) Regulations, 1982,shall, for all intents
and purposes of law, be deemed to have been commenced before the Court of Magistrates in accordance with the provisions of the Criminal Code relating to proceedings before such court sitting as a court of criminal judicature and to be pending before the said court on the date of the coming into force of this Act and on that date adjourned sine die by the said court.
(2) Any charge for any offence made before the coming into force of this Act under the provisions of the Price Control Tribunal (Constitution) Regu lati ons, 1982‡, and any summons issued in
relation thereto, shall be deemed for all intents and purposes of law, to have been made or issued under the provisions of the Criminal Code, and any r e feren c e to the Price Contr o l Tr ibu n al therei n contained shall be read and construed as a reference to the Court of Magistrates.
