The Commercial Code (Amendment) Act (Act No. Xiii Of 2008)

ACT No. XIII of 2008

AN ACT to amend the Commercial Code, Cap. 13.

BE IT ENACTED by the President, by and with the advice and consent of the House of Representatives, in this present Parliament assembled, and by the authority of the same, as follows:-

1. (1) The short title of this Act is the Commercial Code (Amendment) Act, 2008 and this Act shall be read and construed as one with the Commercial Code, hereinafter referred to as “the Code”.

(2) This Act shall come into force on such date as the Minister for Justice and Home Affairs may by notice in the Gazette appoint.

2. The words “Chamber of Commerce”, wherever they occur in the Code, shall be substituted by the words “Chamber of Commerce, Enterprise and Industry”.

3. In article 79(2) of the Code, the word “merchants” shall be substituted by the words “suitable persons”.

Amendment of article 79 of the Code.

Amendment of article 119 of the Code.

Amendment of article 120 of the Code.

4. Article 119(1) of the Code shall be substituted by the following new sub-article:

“(1) The Chamber of Commerce, Enterprise and Industry is a body composed of traders, brokers, master-mariners and all other persons engaged in trade, commerce or industry.”.

5. Article 120(2) of the Code shall be substituted by the following new sub-article:

“(2) The said Council shall represent the commercial, mercantile and industrial community of Malta.”.
