THE METROLOGY ACT (CAP. 454)The Measuring Instrument (Amendment) Regulations, 2011
IN exercise of the powers conferred by article 19 of the Metrology Act, the Prime Minister, acting on the advice of the Malta Standards Authority, has made the following regulations:
1. The Measuring Instrument (Amendment) Regulations,2011 and they shall be read and construed as one with The Measuring Instrument Regulations, 2006 hereinafter referred to as “the principal regulations”.
2. (1) The scope of these regulations is to transpose Commission Directive 2009/137/EC of 10 November, 2009 amending Directive 2004/22/EC of the European Parliament and of the Council on measuring instruments in respect of exploitation of the maximum permissible errors, as regards the instrument- specific annexes M1-001 to M1-005.(2) These regulations shall come into force on 1st
June, 2011.

4. Schedule XI to the principal regulations shall be amendedas follows:
(a) In point 2.1 of Part I thereof, for the words from “When the errors” to the words “for Class 1.0” there shall be substituted

Amends Schedule XII to the principal regulations.
Amends Schedule XIII to the principal regulations.
Amends Schedule XIV to the principal regulations.
“ The gas meter shall not exploit the MPEs or systematically favour any party.”.
(b) In point 8 of Part II thereof, immediately after the words “taken into account” there shall be added, the following paragraph:
“The volume conversion device shall not exploit the MPEs or systematically favour any party.”.
“The meter shall not exploit the MPEs or systematically favour any party.”.
6. In point 3 of the Specific Requirements in Schedule XIII to the principal regulations, immediately after the words “paragraphs 7.1 to 703.” there shall be added the following new paragraph:“The complete heat meter shall not exploit the MPEs or systematically favour any party.”.
7. Immediately after point 2.7 of the Specific Requirements in Schedule XIV to the principal regulations, there shall be added the following new point:“2.8 The measuring system shall not exploit the MPEs or systematically favour any party.”.
