The Malta Freeports (Amendment) Act, 2008 (Bill No. 8)

A BILL

entitled

AN ACT to amend the Malta Freeports Act (Cap. 334).

BE IT ENACTED by the President, by and with the advice and consent of the House of Representatives, in this present Parliament assembled, and by the authority of the same, as follows:-

1. The short title of this Act is the Malta Freeports (Amendment) Act, 2008, and this Act shall be read and construed as one with the Malta Freeports Act, hereinafter referred to as "the principal Act".

2. Paragraph (c) of subarticle (1) of article 6 of the principal

Act shall be amended as follows:
(a) in the second proviso thereof, for the words "shall not be considered to be a title similar to sale;" there shall be substituted the words "shall not be considered to be a title similar to sale:"; and
(b) immediately after the said second proviso, there shall be added the following new proviso:
"Provided further that the Authority may, with the approval of the Minister, create servitudes and other similar rights over areas comprised within a Freeport zone in favour of any land outside the Freeport Zone whenever such rights are required for the proper use of such land;".

Objects and Reasons

The objects of this Bill are to broaden the powers of the Freeport Authority under the relative provision of the law to include the creation of servitudes and similar rights under certain conditions.
