TRAFFIC REGULATION ORDINANCE (CAP. 65)Motor Vehicles (Carriage of Goods by Road) (Amendment) Regulations, 2010

IN exercise of the powers conferred by article 54 of the Traffic Regulation Ordinance, the Minister for Infrastructure, Transport and Communications has, in consultation with the Authority for Transport in Malta, made the following regulations:-

Scope.

Amends regulation

84 of the principal regulations.

1. The title of these regulations shall be the Motor Vehicles (Carriage of Goods by Road) (Amendment) Regulations, 2010, and they shall be read and construed as one with the Motor Vehicles (Carriage of Goods by Road) Regulations, 2003, hereinafter referred to as “the principal regulations”.2. The scope of these regulations is to transpose –

(a) Article 9 of Directive 2006/22/EC on minimum conditions for the implementation of Council Regulations (EEC) Nos 3820/85 and 3821/85 concerning social legislation relating to road transport activities;
(b) Commission Directive 2009/4/EC on counter measures to prevent and detect manipulation of records of tachographs, and
(c) Commission Directive 2009/5/EC amending Annex
III to Directive 2006/22/EC.

3. Regulation 84 of the principal regulations shall be amended as follows:

(a) in sub-regulation (1) thereof immediately after the words “of the undertaking” there shall be inserted the words “in particular for the purposes of and”, and immediately after the words “with Directive 2006/22/EC” there shall be inserted the words “and during inspections for the purposes of the said Directive, authorized inspecting officers shall follow the guidelines on the seriousness of infringements provided for in the Eighth Schedule to these regulations”; and

(b) sub-regulation (2) thereof shall be amended as follows: (i) in paragraph (b) for the words “tachograph
sheets.” there shall be substituted the words “tachograph
sheets, and”;
(ii) immediately after paragraph (b) there shall be added the following new paragraph:
“(c) specific analysis equipment, with appropriate software, to verify and confirm the digital signature attached to data, as well as specific analysis software to provide a detailed speed profile of vehicles prior to the inspection of their recording equipment.”; and
(c) immediately after sub-regulation (2) thereof there shall be added the following new sub-regulations:
“(3) The Authority shall introduce a risk rating system for undertakings for the purposes of Article 9 of Directive 2006/22/EC.
(4) A transport undertaking with a high risk rating under the risk rating system introduced under sub- regulation (3) may make representations to the Authority regarding its rating. The Authority shall consider the representations and notify the undertaking of its conclusions.”.

4. Regulation 85 of the principal regulations shall be amended as follows:

(a) paragraph (e) thereof shall be renumbered as paragraph (f); and
(b) immediately after paragraph (d) thereof there shall be inserted the following new paragraph:
“(e) where appropriate, and with due regard to safety considerations, a verification of the recording equipment installed in vehicles in order to detect the installation and, or use of any device, or devices, intended to destroy, suppress, manipulate or alter any

data, or which is intended to interfere with any part of the electronic data exchange between the component parts of recording equipment, or which inhibits or alters the data in such ways prior to encryption;”.

Adds new Schedule Eighth to the principal regulations.

5. Immediately after the Seventh Schedule to the principal regulations there shall be added the following new Schedule:

Guidelines on a common range of infringements against Regulation (EC) No
561/2006 of the European Parliament and of the Council dated 15 March, 2006 on the harmonisation of certain social legislation relating to road transport and Council Regulation (EEC) No 3821/85 of the 20 December 1985 on recording equipment in road transport, as amended, divided into categories according to their gravity.
